Legal basis: Article 48 of the Civil Procedure Law. Citizens, legal persons and other organizations may be parties to civil litigation.
A legal person shall file a lawsuit by its legal representative. Other organizations are sued by their principal responsible persons.
Article 52 of the Supreme People's Court's Interpretation of Application refers to other organizations established according to law, which have certain organizations and property, but do not have legal personality, including:
(1) A sole proprietorship enterprise that has registered and obtained a business license according to law;
(2) A partnership enterprise registered according to law and obtaining a business license;
(3) Chinese-foreign contractual joint ventures and foreign-capital enterprises registered according to law and obtained the business license of China;
(4) Branches and representative offices of legally established social organizations;
(5) branches of legal persons established according to law and obtaining business licenses;
(6) Branches of commercial banks, policy banks and non-bank financial institutions established according to law and obtained business licenses;
(seven) township enterprises and street enterprises registered to obtain business licenses according to law;
(eight) other organizations that meet the conditions stipulated in this article.
