If a real estate appraisal institution or real estate appraiser issues a false or seriously wrong appraisal report, the issuing authority shall order it to make corrections within a time limit and give a warning. Impose a fine of not less than 50,000 yuan but not more than 200,000 yuan on the real estate appraisal institution, and impose a fine of not less than 65,438 yuan but not more than 30,000 yuan on the real estate appraiser, and record it in the credit file; If the circumstances are serious, the qualification certificate and registration certificate shall be revoked.
The types of administrative duties stipulated in the Regulations on Expropriation and Compensation include: ordering you to make corrections within a time limit, warning, recording in credit files, imposing fines, revoking qualification certificates and registration certificates.
2. Civil liability
As it is a civil act to entrust an appraisal agency to appraise the market price of the expropriated house, real estate appraisal agencies and real estate appraisers shall bear corresponding civil liability for compensation if they issue false or grossly wrong appraisal reports and cause losses to the parties concerned.
Article 52 of the Measures for the Administration of Real Estate Appraisal Institutions stipulates that if a real estate appraisal institution commits one of the acts in Item (1) of Article 32 of these Measures and causes losses to the parties, it shall be liable for compensation according to law. Article 38 of the Measures for the Administration of Certified Real Estate Appraisers stipulates that a certified real estate appraiser who commits one of the acts listed in the second paragraph of Article 16 of these Measures shall be liable for compensation according to law.
3. Criminal responsibility
The false or seriously wrong appraisal report issued by the real estate price appraisal institution or real estate appraiser may constitute the crime of providing false supporting documents by the personnel of intermediary organizations and the crime of making the supporting documents materially untrue.
These two crimes are stipulated in Article 229 of the Criminal Law: "Personnel of intermediary organizations who undertake the duties of asset evaluation, capital verification, verification, accounting, auditing and legal services intentionally provide false documents, and if the circumstances are serious, they shall be sentenced to fixed-term imprisonment of not more than five years or criminal detention and fined.
Whoever commits the crime mentioned in the preceding paragraph, extorts property from others or illegally accepts property from others, shall be sentenced to fixed-term imprisonment of not less than five years but not more than ten years and shall also be fined. If the personnel specified in the first paragraph are seriously irresponsible and the documents issued are seriously inaccurate, thus causing serious consequences, they shall be sentenced to fixed-term imprisonment of not more than three years or criminal detention and shall also or only be fined.
