Will the branch have articles of association?

Legal analysis: branches should have independent articles of association. Although the branch does not have the qualification of an independent legal person, it needs to register its name, business place, person in charge and business scope. If the company registration authority of a branch company approves the registration, it shall issue a business license. The company shall, within 30 days from the date of registration of the branch, file with the company registration authority with the business license of the branch.

Article 4 An industrial and commercial enterprise applying for registration shall be a unit directly engaged in production and operation and independent accounting. Non-independent accounting branches of industrial and commercial enterprises shall be uniformly applied for registration by industrial and commercial enterprises.

Article 5 The main items that an industrial and commercial enterprise should register are: the name and address of the enterprise, the name of the person in charge, the date of preparation or opening, the economic nature, the scope of production and operation, the mode of production and operation, the total amount of funds, and the number of employees or employees.

Article 6 Industrial and commercial enterprises are only allowed to register and use one name. In the same city and county, the names of industrial and commercial registration enterprises in the same industry shall not be used.

Article 7 Where the establishment of an industrial and commercial enterprise requires capital construction, it shall, within 30 days after the approval of the construction project, apply to the municipal or county administration for industry and commerce for registration of preparation. After the completion of an industrial and commercial enterprise, it shall apply to the municipal or county administration for industry and commerce for industrial and commercial registration within 30 days before it is put into operation or opened for business.

Article 8 If the establishment of an industrial and commercial enterprise does not require capital construction, it shall directly apply for industrial and commercial registration without going through the preparatory registration. After being approved to start business, an application for industrial and commercial registration shall be filed with the municipal or county administration for industry and commerce within 30 days.
