▲ Which step has it reached?
"Overwork" seems to have become the norm in the workplace in China. Overtime is the primary cause of overwork death. According to statistics, the number of people who die of karoshi in China reaches 600,000 every year, which has surpassed Japan to become the largest country in karoshi.
The object of karoshi threat has changed from manual workers to mental workers, and it is getting younger and younger. This data is very simple ... men are silent, women are crying, so they say they will postpone retirement?
▲ Where do you not work overtime in your life?
Since overtime is so harmful to life, refuse to turn overtime into the norm! However, as we all know, in China, if you don't want to work overtime, you don't have to work overtime. You can either work overtime or resign! How to make money without overtime?
Either overwork or hunger. However, if overtime is unpaid, weekends are useless, and business trips and meals are deducted from wages, then ... just wait for your body to be hollowed out and your life to be overdrawn.
▲ The helplessness of office workers
Despite the provisions of Article 36 and Article 4 1 of the Labor Law, the state implements a working-hour system in which the daily working hours of laborers do not exceed 8 hours and the average weekly working hours do not exceed 44 hours.
Due to the needs of production and operation, the employer may extend the working hours after consultation with the trade unions and workers, generally not exceeding one hour per day; If it is necessary to extend the working hours for special reasons, the extended working hours shall not exceed three hours a day and thirty-six hours a month under the condition of ensuring the health of the workers. If the employer does not pay overtime, the labor administrative department will order it to pay compensation to the workers ... but there is no such thing as tea eggs. ...
▲ If you ruin your body for work, it is meaningless to live!
There is no clear regulation on the correlation between disease onset and work in China, which leads to the embarrassing situation that karoshi has no legal protection.
So, is karoshi a work-related injury?
Article 14 of the Regulations on Work-related Injury Insurance stipulates that "those who are injured by accidents during working hours and workplaces" shall be recognized as work-related injuries.
At the same time, Article 15 stipulates that "a person who died of sudden illness or died within 48 hours after being rescued" should be recognized as a work-related injury.
▲ Are you talking about overtime dogs?
In other words, if karoshi is recognized as a work-related injury, three conditions must be met:
First, work reasons, whether employees died due to work reasons;
The second is working hours, whether it belongs to the time needed for work, which of course includes overtime;
Third, whether the workplace belongs to the area involved in the work and the reasonable area of natural extension. In addition, those who died after more than 48 hours of rescue cannot be counted as work-related injuries!
Articles 14 and 15 of the Industrial Injury Insurance Regulations seem to have found a legal basis for karoshi, but in practice, many karoshi deaths do not fall at work during working hours, and many karoshi deaths fall at home, and the rescue time is far more than 48 hours.
▲ Only when you are alive can you enjoy life.
If karoshi is not a work-related injury, who will pay for their lives?
Articles 2 and 6 of the Tort Liability Law of People's Republic of China (PRC) stipulate: "Anyone who infringes upon civil rights and interests shall bear tort liability in accordance with this Law. The civil rights and interests mentioned in this Law include the right to life and health. ""If an actor infringes upon the civil rights and interests of others through fault, he shall bear the tort liability ".
Therefore, it should be recognized that the company has tort and is subjectively at fault, and family members can ask the employer to bear tort liability.
▲ The light in the office building is the burning life.
Look at this city. Lights are brightly lit all night. Those tall office buildings seem to be competing for who turns off the lights the latest. It looks beautiful, but how many people are burning their lives and working overtime. I don't know when it started. Overtime has become the norm for many people and seems to be a political correctness.
In this atmosphere, everyone must hide his inner heart of "seeking pleasure and comfort". In fact, besides life and death, what else is important in this world?
Health first, moderate work. When you die, the company can recruit another person to replace you, but your parents are only you.
