Facts and reasons: On April 24, 2007, the plaintiff signed a labor contract with the defendant Wuhan Wenyu Landscape Lighting Engineering Co., Ltd., and the plaintiff provided labor services for the project contracted by the defendant in the Garden Garden Garden of Wang Long Office in Zhengzhou District. From July 2065438 to July 2007, the defendant issued several statements to the plaintiff. After repeated reminders from the plaintiff, the defendant still owed the plaintiff the labor fee 142, of which 790 yuan refused to pay it. Oriental Tianyu Group Co., Ltd. is the contractor of this project. In order to protect their legitimate rights and interests, the plaintiff brought a lawsuit to the court and asked the court to make a judgment according to law. Oriental Tianyu Group Co., Ltd. objected to the jurisdiction when submitting the defense, arguing that the registered place and main office of the defendant Oriental Tianyu Group Co., Ltd. are located in Zhengzhou High-tech Industrial Development Zone, so the court should transfer it to the court where Oriental Tianyu Group Co., Ltd. resides, that is, the people's court of Zhengzhou High-tech Industrial Development Zone for jurisdiction and trial. Upon examination, our court holds that according to Article 23 of the Civil Procedure Law of People's Republic of China (PRC), "a lawsuit arising from a contract dispute shall be under the jurisdiction of the people's court of the defendant's domicile or the place where the contract is performed". Plaintiff Ding signed a labor contract with defendant Wuhan Wenyu Landscape Lighting Engineering Co., Ltd., and Ding provided labor services in the old garden of Wanglong Office in Zhengzhou District. The place of performance of the contract is Zhengzhou Airport Economic Comprehensive Zone, and our court has jurisdiction over this case. According to Article 35 of the Civil Procedure Law of People's Republic of China (PRC): "If two or more people's courts have jurisdiction over a lawsuit, the plaintiff may bring a suit in one of them. ……"。 In this case, the plaintiff brought a lawsuit to our hospital, which was in compliance with the law. The defendant's proposal to transfer the case to the court of the defendant's domicile has no legal basis, and the objection cannot be established and should be rejected.
