According to Article 57 of the Company Law of People's Republic of China (PRC), the legal representative of a company or enterprise whose business license has been revoked due to violation of the law shall be personally liable for the illegal acts of the enterprise. If it has not been more than three years since the business license of a company or enterprise was revoked, it shall not serve as a director, supervisor or manager of the company.
The State Administration for Industry and Commerce's Regulations on the Administration of the Registration of Legal Representatives of Enterprises as Legal Persons [5] also clearly stipulates that the legal representative of an enterprise whose business license has been revoked due to violation of the law shall not be the legal representative of other enterprises if it has not been more than three years since the date of revocation of the business license of the enterprise.
