An insurance company applying for the establishment of a provincial branch shall meet the following conditions

Legal analysis: First, it conforms to its own development plan. Among them, if an insurance company established within three years sets up a provincial branch, which is inconsistent with the development plan submitted when the company is established, it shall explain the reasons.

Two, the solvency of the previous year and the two consecutive quarters before submitting the application have reached the sufficient category, and the classified supervision category of the previous year and the two consecutive quarters before submitting the application is not lower than the B category.

Three, with good corporate governance, sound internal control, with a sound branch management system.

4. There is no record of any major administrative penalty imposed by the financial regulatory agency in the last two years.

5. There is no case where the applicant or its managers are suspected of committing a major crime due to their work behavior and are being investigated by the financial regulatory agency or the judicial organ.

Six, the established provincial branch is operating normally, and has not withdrawn from the provincial branch market in the last two years, and has a person in charge of the preparation that meets the qualifications of senior management personnel of the provincial branch.

Legal basis: Branch companies can be established in Article 14 of People's Republic of China (PRC) Company Law. The establishment of a branch company shall apply to the company registration authority for registration and obtain a business license. A branch company does not have legal person status, and its civil liability shall be borne by the company.

A company may set up subsidiaries, which have legal personality and independently bear civil liabilities according to law.
