Within six months after submitting the application, the applicant must make a registration request, otherwise the application will be invalid. 4. Don't make your design public.
If you want your design to be protected by law, you must keep your design secret. To be certified and legally binding, a design must have two characteristics: novelty and uniqueness.
5, review and certification
After the design is registered, the obligee may apply for examination, and the right to design will become legally effective after passing the examination and issuing certificates. The advantage of certification is that if others use your design without permission, you can take action to stop it according to law. You can only do this if you are certified. Another purpose of the review is to find the early approximate design that you want to protect. If the examiner finds that an earlier design is similar or the same as yours, then you can't pass the exam, even if you applied for it yourself.
Step 6 ask for disclosure
Publicity is an alternative to registration. When you can't register your design, publicity is regarded as a defensive strategy. After the parties apply for publicity, the Australian Patent Office will publicize the design in the design announcement and include it in the Australian design retrieval database.
