What applications should be submitted for Korean invention patents?

(1) Applicant

The inventor or the agent of the inventor may submit a patent application to the Korean Intellectual Property Office. The applicant can be a natural person or a legal person.

(2) Document requirements

The applicant must submit the following documents to the Korean Intellectual Property Office:

A the name and address of the applicant (if it is a legal person, the name and business place of the legal person);

B name and priority date of the invention (if priority protection is required);

C the application documents must contain the contents of the invention, a brief description of the drawings, a detailed description and the claims;

D. attached drawings;

E. summary;

F if there is a priority requirement, the Korean version of the priority document and the original and copy of the priority application shall be submitted (if the applicant is required to submit the Korean version of the priority document).

(3) Priority

The applicant can enjoy the priority within 1 year after the patent application is filed. The above priority documents shall be submitted within 16 months from the start date of priority. If it is not submitted within this time limit, it will not enjoy priority.
