What materials should be submitted for reexamination when the patent application is rejected?

The following materials shall be submitted for patent reexamination: reexamination request, explanation of reasons and relevant evidence, etc. According to the relevant laws and regulations, if a party requests a reexamination from the Patent Reexamination Board, it shall submit a request for reexamination, explain the reasons, and attach relevant evidence when necessary.

Article 6 of the Detailed Rules for the Implementation of the Patent Law of the People's Republic of China

Where a request for reexamination is made to the Patent Reexamination Board in accordance with the provisions of Article 41 of the Patent Law, a request for reexamination shall be submitted, with reasons explained and relevant evidence attached if necessary.

if the request for reexamination does not conform to the provisions of the first paragraph of Article 19 or the first paragraph of Article 41 of the Patent Law, the Patent Reexamination Board shall not accept it, and notify the petitioner in writing and explain the reasons.

if the request for reexamination does not conform to the prescribed format, the person requesting reexamination shall make corrections within the time limit specified by the Patent Reexamination Board; If no correction is made at the expiration of the time limit, the request for reexamination shall be deemed not to have been made.
