1. Submit the application. Enterprises in China submit applications for trademark registration to the United States Patent and Trademark Office (USPTO), and at the same time submit the materials required for applying for trademark registration in the United States;
2. Formal review: When the trademark authority in the United States, that is, USPTO receives an application for trademark registration, it will arrange staff to review whether the trademark application meets the basic requirements for trademark registration. If the formal examination is successfully passed, USPTO will issue the date of trademark application and issue a notice of trademark acceptance;
3. Substantive examination: After the trademark application has passed the formal examination, the staff of the United States Patent and Trademark Office (USPTO) will conduct further substantive examination on the trademark registration application to decide whether the trademark can be registered. If the registration cannot be decided after examination, the applicant shall be required to correct the relevant contents by issuing the application for rejection and the reasons for rejection;
4. Make an announcement. After the application for trademark registration has passed the substantive examination in the United States, it will be published in the official trademark journal of the United States for a period of three months. During this period, anyone has the right to object to the application for trademark registration.
5. approve the registration. During the announcement period, the application for trademark registration in the United States did not receive any objection or the objection was unfounded, and the trademark was officially approved and registered in the USPTO.
American trademark registration fee is divided into two parts: registration fee and agency fee. Since August 3rd last year, the United States Patent and Trademark Office has required China enterprises and individuals to apply for American trademarks, and only American lawyers can submit applications on their behalf. So it is necessary to find a trademark agency to register American trademarks now. The official fees are as follows:
1. If the application is made by traditional paper method, the application fee for each American trademark registration category is 500 USD;
2. If the US trademark is registered through the teas routine application method of the US electronic application, the formal application fee for each US trademark registration category is $400;
3. If an American trademark applies for registration through electronic teasrf, the formal application fee for each American trademark registration category is $272;
4. If the American trademark is registered by electronic teasplus application, the official application fee for each American trademark registration category is $225.
The fees charged by each trademark registration agency are different, generally ranging from 4,000 to 7,000, depending on the services it provides.
