2. Acceptance and payment: China National Intellectual Property Administration accepts the application and the parties pay the patent application fee;
3. Preliminary review: China National Intellectual Property Administration will conduct preliminary review after acceptance;
4. Announce in advance: announce immediately after the first trial is passed;
5. Substantive examination: China National Intellectual Property Administration conducts substantive examination according to the requirements of the applicant;
6. Authorized registration: after examination and approval, the invention patent certificate is authorized to be issued, and registration and announcement are made at the same time.
Applications for patents for utility models and designs do not include substantive examination and early publication.
The way to apply for a patent:
1. Apply by yourself. Go directly to China National Intellectual Property Administration to apply for a patent or apply for a patent by registered mail (the patent application documents include: the request, the patent claim, the specification, the appended drawings of the specification, the abstract of the specification and the appended drawings of the abstract).
2. Agency application. Entrust a patent agent to handle patent applications. By using this method, the quality of patent application is high, and the delay of verification and authorization due to the quality problems of application documents can be avoided.
