The deadline for submission of SOU or request for extension of submission period shall be calculated from the date of issuance of NOA. If the applicant fails to submit the SOU or extension request within 6 months after this date, the application will be abandoned.
5. The United States Patent and Trademark Office examines the use statement.
If the minimum requirements are met, the statement of use will be forwarded to the examiner. The examiner will decide whether federal regulations allow registration. Even if the application is rejected for legal reasons, the applicant cannot withdraw the declaration of use and the application fee will not be refunded.
6. The use statement is recognized and the logo is registered.
If there is no reason for rejection or no supplementary content is needed, the examiner will approve the use statement. The United States Patent and Trademark Office will issue a registration certificate within 2 months after approving the use statement.
