How to check whether the patent is authorized?

Legal analysis: Generally, there are three situations:

(1) First enter official website and China National Intellectual Property Administration, click "Patent Search and Query" in the menu bar above, and then click "China Patent Query System" again after entering.

(2) After entering "China Patent Inquiry System", click "Click to Enter" under public inquiry, and then select "Agree to the above statement" to continue.

(3) Enter the name of the patent, make an inquiry, and then click "Basic Information" of the patent to see whether the patent has been authorized, withdrawn or expired.

Legal basis: Article 35 of the Patent Law of People's Republic of China (PRC). Within three years from the date of filing, the administrative department for patent in the State Council may, upon the request of the applicant at any time, make a substantive examination of the application. If the applicant fails to request substantive examination within the time limit without justifiable reasons, the application shall be deemed to have been withdrawn.

The patent administrative department of the State Council may, when it deems it necessary, examine the application for a patent for invention on its own.
