First, it is stipulated that promising to sell unauthorized patented products of inventions or utility models or products directly obtained by using patents constitutes infringement;
Second, it is stipulated that those who use or sell patented products that are not known to be manufactured or sold without permission shall be investigated for certain civil liabilities. According to the judicial interpretation, civil liability shall be investigated according to the time when the infringement occurred: the old law shall apply to the infringement that occurred before July 1 year, and the revised patent law shall apply after that. In other words, the act of committing to sell before July 1 day will not be investigated for tort liability. If the above acts continue after July 1 day (including July 1 day), the tort liability will be investigated according to the revised Patent Law.
