At any time within 10 years after the design is registered, the owner or a third party can request a substantive examination of the design, that is, conduct an examination of novelty and uniqueness, after which the Intellectual Property Office will issue a Examination certificate (if the design is valid) or cancellation of registration (if the design is invalid). The practical review process generally takes 4-6 weeks to complete. A decision to set aside can be appealed to the Australian courts.
