How to fill in the patent amendment form?

Patent amendments are very particular. They must neither be unmodified nor be modified beyond the scope.

The examiner will write down the requested supplements and corrections in the notice of correction and modify the application documents one by one based on the examiner’s opinions.

1. This form should be filled in in Chinese, the handwriting should be black, the text should be typed or printed, and submitted in duplicate.

2. The content filled in column ① of this form should be consistent with the content in the patent request. If the application has gone through the procedures for changing the recorded items, it should be filled in according to the content after the change is approved by the Patent Office.

3. The applicant filled in column ① of this form should be the first signed applicant.

4. The squares in column ② of this form are for the person who fills in the form to choose, and they should be marked in the squares.

5. When an invention patent applicant files a request for substantive examination and within 3 months from the date of receipt of the notice from the Patent Office that the invention patent application has entered the substantive examination process, the invention patent applicant may take the initiative to submit the invention patent application. Revise.

Applicants for utility model or design patents may proactively propose modifications to their utility model or design patent applications within 2 months from the filing date.

6. For modifications to the description or claims of an invention or utility model patent application, except for modifications or additions or deletions of individual words, replacement pages must be submitted in accordance with the prescribed format. For an invention patent application involving nucleotide or amino acid sequences, if the sequence listing is modified voluntarily or at the request of the examiner, a paper replacement page and a CD or floppy disk consistent with the contents of the replacement page should be submitted. For modifications to pictures or photos in a design patent application, replacement pages must be submitted in accordance with regulations.

7. In column ⑤ of this table, if a patent agency is entrusted, the patent agency shall affix its official seal. If a patent agency is not entrusted, the applicant shall be signed or stamped by himself if he is an individual; if the applicant is an organization, the official seal of the unit shall be stamped; if there are multiple applicants, the first signature applicant shall be signed or stamped.
