Alipay QR code scanning service sued for infringement

In the era of mobile Internet, QR codes have become an important interactive medium, and "scanning QR codes" has also become a daily life for people. The technological innovation and intellectual property protection behind the new business model of QR code scanning services have attracted more and more people's attention.

On September 8, 2021, the Beijing Intellectual Property Court held an online hearing to hear the case of Fama Bank Industrial (Shanghai) Co., Ltd. v. Alipay (China) Network Technology Co., Ltd. over the infringement of invention patent rights.

The plaintiff claimed: The plaintiff is the holder of the invention patent No. 201210113851.8 "Method, device and mobile terminal for communication using barcode images" (referred to as the patent involved). The defendant, without the permission of the plaintiff, used the production and operation For the purpose of promoting and operating "Alipay" around the world including Beijing, providing QR code scanning services, and implementing the patent involved, it infringed the plaintiff's patent rights and benefited hugely. At the same time, it also caused losses to the plaintiff. We requested the court to order : The defendant immediately stopped using the patent involved in Alipay and compensated the plaintiff for economic losses including reasonable expenses of 6.5 million yuan.
