The Legal Responsibility of Malicious Complaint Lawyers

This kind of responsibility includes civil responsibility, administrative responsibility and criminal responsibility.

1, civil liability. According to the Tort Liability Law of People's Republic of China (PRC), a malicious complainant shall bear civil liability, including compensation for the economic losses and mental damages of the respondent.

2. Administrative responsibility. According to the Law of People's Republic of China (PRC) on Public Security Administration Punishment, malicious complainants will face administrative penalties, including warnings and fines.

3. Criminal responsibility. According to the Criminal Law of People's Republic of China (PRC), a malicious complaint can constitute a crime of libel, extortion, etc., and the maximum sentence can be 10 years in prison.
