4.2 Design pictures or photos
Paragraph 2 of Article 59 of the Patent Law stipulates that the protection scope of the design patent right shall be based on the design of the product shown in the picture or photograph, and the design of the product shown in the picture or photograph may be explained by a brief description. Paragraph 2 of Article 27 of the Patent Law stipulates that the relevant pictures or photographs submitted by the applicant shall clearly indicate the design of the product for which patent protection is required.
As far as the appearance design of three-dimensional products is concerned, if the main points of product design involve six faces, the orthographic views of the six faces shall be submitted; If the main points of product design only involve one or several faces, at least the front view and three-dimensional view of the faces involved shall be submitted, and the reasons for omitting the views shall be explained in a brief explanation.
As far as the appearance design of plane products is concerned, if the design points of products involve a plane, only the orthographic view of the plane can be submitted; If the key points of product design involve two sides, two orthographic drawings shall be submitted.
When necessary, the applicant shall also submit the developed drawing, sectional drawing, sectional drawing, enlarged drawing and change state drawing of the designed product.
In addition, the applicant can submit reference drawings, which are usually used to indicate the purpose, method or place of use of the product using the design.
Colors include black, white and gray series and color series. For an application for a patent for design that requires color protection in the brief description, the color of the picture should be firmly colored and not easy to fade.
