When will the patent right take effect?

The entry into force of patent right means that the patent right for invention, utility model and design shall come into effect from the date of announcement, and the effective date shall be the date of announcement. Because the patent right is the exclusive right granted by the patent management department after the patentee has applied for and passed the examination. According to the provisions of the Patent Law, if the application for a patent for invention has been substantially examined, and the application for a patent for utility model and design has not found any reasons for rejection after preliminary examination, the patent administration department of the State Council shall make a decision to grant the patent right, issue the corresponding patent certificate, and register and announce it at the same time. We usually say that the certification date, registration date and announcement date are actually the same day. The patent right shall take effect from the date of announcement, that is, the patentee may enjoy the exclusive right to exploit the patent from the date of announcement.
