Foreign patent application channels:
The first is the more traditional method, that is, the practice of Paris Convention: the applicant should submit an application to the patent offices where several Paris Convention member countries are located within 12 months from the priority date and pay the corresponding fees. In this way, applicants may not have enough time to prepare documents and raise fees.
The second method is PCT: the applicant directly submits a PCT international application written in Chinese or English to China National Intellectual Property Administration, China within 12 months from the priority date. After the international application is confirmed, it will have the effect of formal national application in all PCT member countries.
Benefits of applying for foreign patents through PCT:
1, the applicant can apply in Chinese;
2. The applicant may file an application with the Chinese Patent Office to request foreign countries to grant patent protection;
3. The applicant only needs to submit a set of Chinese (or English) application documents to the Chinese Patent Office to determine the application date of the application, which is regarded as an application filed in each designated country on the same day;
4. Before entering the national phase of each country, the applicant has obtained the international search report and the international preliminary examination report. Through these two reports, the applicant can preliminarily judge the prospect of the application being granted a patent right in patent offices in various countries, so as to decide whether it is necessary to continue the national phase;
5. Postpone the entry into the national phase, so that the applicant can decide whether it is necessary to enter the scheduled designated country according to the market prospect and technological progress. Delaying the entry into the national phase generally does not affect the time for granting the patent right.
Through the PCT channel, that is, apply for an international application to WIPO, and then, within 30 months, enter the country that wishes to apply through PCT. Through PCT patent application, we can enter more countries and protect patents more comprehensively.
