Do patent licenses need to be filed?

Legal subjectivity:

Patent license needs to be filed. The parties concerned shall go through the filing formalities within 3 months from the effective date of the patent licensing contract.

Article 5 of the Measures for Filing Patent License Contracts, the parties concerned shall go through the filing procedures within 3 months from the date when the patent license contract takes effect.

Article 2 China National Intellectual Property Administration is responsible for filing the national patent licensing contract.

Article 7 The parties concerned may go through the formalities for filing the patent licensing contract by mail, direct delivery or other means stipulated by China National Intellectual Property Administration.

Article 8 To apply for filing a patent licensing contract, the following documents shall be submitted:

(1) An application form for filing a patent licensing contract signed or sealed by the licensor or the patent agency entrusted by it;

(2) Patent licensing contracts;

(3) Identification certificates of both parties;

(4) If a patent agency is entrusted, the power of attorney of the authorizing organ shall be indicated;

(5) Other materials that need to be provided.

Legal objectivity:

According to the detailed rules for the implementation of China's patent law, if the patentee licenses others to use the patent, he shall sign a license contract and put it on record. According to the relevant laws, Article 14 of the Detailed Rules for the Implementation of the Patent Law of People's Republic of China (PRC) * * * If the patent right is transferred for other reasons, the parties concerned shall go through the patent transfer formalities with the patent administration department of the State Council with relevant supporting documents or legal documents. The patent licensing contract concluded between the patentee and others shall be filed with the patent administrative department of the State Council within 3 months from the date when the contract comes into effect. Where the patent right is pledged, the pledger and pledgee shall register the pledge with the patent administration department of the State Council.
