The idea followed by the patent system

Legal analysis: applying for patent and exercising patent right should follow the principle of good faith. As an intangible property right, patent right is different from property right. Sometimes, it should follow the special rules for exercising its rights. However, China's patent law and its implementation rules do not stipulate this. Therefore, this aspect should be added when the patent law is revised. Patent right is an intangible property right, and its object is intangible technical information, which can be enjoyed by multiple subjects, and its use will not be worn or damaged like tangible things.

Legal basis: Article 20 of the Patent Law of People's Republic of China (PRC) shall follow the principle of good faith when applying for a patent and exercising the patent right. Do not abuse the patent right to harm the public interest or the legitimate rights and interests of others. Abuse of patent rights, exclusion or restriction of competition, which constitutes a monopolistic behavior, shall be dealt with in accordance with the Anti-Monopoly Law of the People's Republic of China.
