Measures of Fuzhou Municipality on Incentives for Independent Intellectual Property Rights
Chapter I General Principles
Article 1 In order to vigorously support and cultivate independent intellectual property rights, give full play to the role of the intellectual property system in Fuzhou's scientific and technological innovation and economic development, and improve the construction level of a national intellectual property demonstration city, according to the Notice of Fuzhou Municipal People's Government on Printing and Distributing Several Support Policies for Fuzhou to Create a National Innovative City (No.2011] 54) and the Work Plan for Fuzhou to Create a National Intellectual Property Demonstration City (No.
Article 2 Fuzhou special funds for intellectual property rights (hereinafter referred to as special funds) shall be included in the fiscal budget, and Fuzhou Intellectual Property Office shall be specifically responsible for the management and use of special funds, and Fuzhou Science and Technology Bureau and Fuzhou Finance Bureau shall supervise and inspect the management and use of special funds.
Article 3 Special funds are mainly used to support and reward intellectual property demonstration enterprises, patent application grants and awards, patent industrialization implementation, patent pledge loan discount, patent insurance grants, patent awards and intellectual property protection, publicity and training, strategic research, advanced technology identification and awards.
Chapter II Awards for Intellectual Property Demonstration Enterprises
Article 4 Enterprises and institutions listed in the national, provincial and municipal intellectual property demonstration organized by Fuzhou City will be rewarded with 300,000 yuan, 200,000 yuan and 65,438+10,000 yuan respectively. The above rewards shall be subject to the maximum amount or make up the difference.
Article 5 Fuzhou intellectual property demonstration enterprises shall be reviewed once a year, and the demonstration period shall be three years. The Municipal Intellectual Property Office shall issue the declaration guide for Fuzhou intellectual property demonstration enterprises. Upon the expiration of the review, qualified enterprises can continue to be awarded the title of Fuzhou Intellectual Property Demonstration Enterprise, and no financial reward will be given.
Article 6 The projects recommended by Fuzhou and included in the patent technology implementation and industrialization plan of Fujian Province shall be matched with funds according to 30% of the provincial project support funds, and the total amount of each matching fund shall not exceed 300,000 yuan.
Article 7 The same loan recommended by Fuzhou to be included in the discount project of Fujian patent pledge loan shall be given a discount. The discount rate is 30% of the benchmark interest rate of bank loans in the same period. From the date of discount calculation, the longest discount time shall not exceed 1 year, and the maximum discount amount enjoyed by each enterprise shall not exceed 300,000 yuan.
Article 8 Subsidies shall be given to the insurance expenses paid by enterprises for purchasing patent insurance, and the subsidy standard shall be 50% of the actual premium paid. The total amount of subsidy funds obtained by each enterprise in a single year shall not exceed 1 10,000 yuan.
Subsidized patent insurance enterprises mainly refer to intellectual property demonstration enterprises and high-tech enterprises at or above the municipal level. After the enterprise has purchased patent insurance for one year, it will subsidize the expired patent insurance in June every year, and submit relevant documents in accordance with the declaration guidelines issued by Fuzhou Intellectual Property Office.
Chapter III Funding and Awards for Patent Applications

Funding and incentive funds are pre-allocated by Fuzhou Municipal Finance Bureau and distributed quarterly by Fuzhou Intellectual Property Office. Article 10 Patent applications shall be funded and matched according to the scope stipulated by Fujian Intellectual Property Office; The patent authorization reward is 5,000 yuan for each invention patent authorized by the enterprise and 2,500 yuan for each invention patent authorized by the institution or individual; For enterprises that have obtained invention patents authorized by the United States, the European Union and Japan, each award is 1 000 yuan, and the same authorized patent award does not exceed two countries.
Chapter IV Establishment and Grant of Patent Awards
Eleventh Fuzhou patent award included in the Fuzhou municipal science and technology progress award sequence, reviewed once a year. Divided into two categories: patent gold award and excellent award. Fuzhou Municipal Science and Technology Bureau and Fuzhou Municipal Intellectual Property Office issued "Fuzhou Patent Award Declaration Guide", and the reward measures are implemented with reference to the provisions of "Fuzhou Science and Technology Progress Award Measures". One-time awards of 60,000 yuan and 20,000 yuan were given to the patentees who won the Fuzhou Patent Gold Award and the Patent Excellence Award respectively.
Twelfth units or individuals that have won the Fuzhou National Patent Award shall be rewarded. The patentee who won the China Patent Gold Award and the China Patent Excellence Award received a one-time award of 300,000 yuan and 654.38+10,000 yuan respectively.
Chapter V Supplementary Provisions
Thirteenth reporting units or individuals should provide true materials and vouchers, if there is fraud, once found, all the fees paid will be refunded, and their declaration will not be accepted within 3 years. If the circumstances are serious, the responsibility will be investigated according to law.
Article 14 These Measures shall be interpreted by Fuzhou Science and Technology Bureau and Fuzhou Intellectual Property Office.
Fifteenth these Measures shall come into force as of the date of promulgation, and the original Measures of Fuzhou Municipality on Encouraging and Cultivating Independent Intellectual Property Rights (Fuzhou Comprehensive [2008] No.63) shall be stopped at the same time. Projects that meet the requirements of the original measures shall apply for formalities within six months from the date of implementation of these measures, and shall be deemed to have given up after the deadline.
