The difference between patent applicant and obligee

A patent applicant is a natural person or legal person who applies to the patent administration department in the State Council and requests the patent administration department in the State Council to grant a patent right. It should be noted here that not any natural person or legal person has the right to apply for a patent. The natural person or legal person who has the right to apply for a patent is: ① the inventor of a non-service invention-creation or his legal successor. The so-called legal heir means that the legal heir inherits the patent application right due to the death of the inventor. (2) The legal entity to which the service invention-creation belongs. For service inventions, the right to apply for a patent belongs to the unit. ③ Legal assignee. Refers to the inventor of a non-service invention or the person or unit to which he belongs who voluntarily transfers the right to apply for a patent for invention-creation with or without compensation. ④ * * * Same as the applicant. * * * Applicants refer to individuals and individuals who apply for patents. Individuals and units or units and units. * * * Among the applicants, if there is a contract in advance, it shall be handled according to the contract. When filing a patent application, the assignee or heir of the patent application right shall submit the certification documents of the assignee or heir. If the applicant is an individual, his/her real name shall be used, and no pen name or pseudonym shall be used. If the applicant is a unit, the official full name shall be used. The patentee is the person who enjoys the patent right according to law, that is, the patent applicant who was granted the patent right when the patent was approved. The patentee can be a natural person or a legal person. During the term of validity of a patent, the patentee may transfer the patent right, and at the same time the patent right may be inherited. Therefore, the patent right can be changed. When the right is changed, the patent administrative department of the State Council will register the name of the new patentee and announce it in the patent gazette, instead of rewriting it on the patent certificate.
