Legal analysis: prisoners have the capacity for civil rights. Generally speaking, criminals can only exercise their personal rights within the detention center or prison. Beyond the scope of the detention center or prison, it shall entrust an agent to exercise it on its behalf. Specifically, criminals' personal rights such as personal rights and property rights are protected by law and can exercise their rights independently according to their own wishes. Prisoners' personal rights and intellectual property rights, such as life and health rights, name rights, reputation rights, marital autonomy, invention rights and patent rights, can be exercised by prisoners themselves in detention centers or prisons. Although the law also protects the property ownership and other real rights, creditor's rights and inheritance rights left in the detention center or outside the prison, criminals can only entrust agents to exercise them on their behalf.
Legal basis: Article 13 of the Civil Code of People's Republic of China (PRC). A natural person has the capacity for civil rights from birth to death, enjoys civil rights and assumes civil obligations according to law.
