Relevant regulations:
Paragraph 2 of Article 4 of the Detailed Rules for the Implementation of the Patent Law of People's Republic of China (PRC) stipulates: "If a party entrusts a patent agency, the documents shall be sent to the patent agency; If a patent agency is not entrusted, the document shall be sent to the contact person specified in the request. " This requires the applicant to "designate" the contact person when filing the patent application.
China's "Patent Examination Guide" stipulates: "If the applicant is a unit and has not entrusted a patent agency, the contact person shall be filled in. The contact person is the recipient of the letter sent by the Patent Office, not the unit. The contact person should be the employee of the company ... "The author thinks that this provision is a supplement to the patent examination part in the detailed rules for the implementation of the Patent Law, which combines the theme of Article 1 of the Patent Law of People's Republic of China (PRC), strengthens the control of the company as an applicant, prevents the disclosure of patent contents and strengthens the rights and interests of the applicant. However, in reality, many "non-employees" are regarded as patent application contacts.
