Creativity comes in two forms:
(1), the invention, innovation and transformation of machinery and equipment, instruments and various consumer goods, as well as related manufacturing processes, production processes and detection and control methods, all belong to inventions.
(2) It is also a kind of reprocessing behavior to discover people's understanding of the inner and concrete nature of self and its whole.
The expression of originality, as far as works are concerned, contains or embodies ideas, information and creative techniques.
2. They have different meanings.
Creativity refers to the ability or characteristics of individuals to produce novel and unique products with social value, so it is also called creativity. Having social value means that the results or products created have practical or academic value, moral value, aesthetic value and so on.
Originality, also known as originality or originality, refers to the non-imitation (non-plagiarism) and difference of a work produced by independent creation. And it does not involve the ideas, information and creative techniques contained or embodied in the work.
They have different characteristics.
Creativity is stipulated in Article 22 of the current Patent Law: compared with the existing technology, the invention has outstanding substantive characteristics and remarkable progress, and the utility model has substantive characteristics and progress. It is fluent, flexible and unique.
In originality, if two or more people cooperate, it is original because it is not a complete or substantial imitation of the existing works, because it is different from the existing works.
4. The requirements are different.
Creativity needs three parts: creative consciousness, creative thinking process and creative activities. Creative thinking is its core, which includes convergent thinking and divergent thinking. Divergent thinking is the core of creative thinking and has the closest relationship with creative thinking.
The requirement of originality means that the invention must be original and unprecedented. The originality requirement of a work only means that the work is not plagiarized and different, even if it is similar to the existing work through coupling.
