The drawing of 4?2?2 pictures
The pictures should refer to the relevant orthographic
projection relationships, line widths and sections in my country’s national standards for technical drawing and mechanical drawing. The design shall be drawn according to the provisions of the cutting mark, and shall express the shape of the design with solid lines of uniform thickness
. The shape of the design shall not be expressed by lines such as hatching lines, indicator lines, dashed
lines, center lines, dimension lines, dotted lines, etc. You can
use two parallel double-dotted lines or natural break lines to indicate the omitted parts
of elongated items. Indicator lines can be used on the drawing to indicate the cutting position and direction, enlarged parts, transparent parts, etc., but there must be no unnecessary lines or marks. Pictures should clearly convey
the design.
Pictures can be drawn using drawing tools, including computers, but pencils, crayons, ballpoint pens, blueprints, sketches, and mimeographs are not allowed
p>pieces. For appearance design pictures drawn by computer, the picture resolution should meet the requirements of clarity.

4?2?3 Photography
(1) The photo should be clear to avoid the appearance of the product being unable to be clearly displayed due to focusing or other reasons.
(2) The background of the photo should be single, and other content other than the design product should be avoided.
There should be an appropriate brightness difference between the product and the background to clearly show the design of the product
.
(3) Photos should usually be taken according to orthographic projection rules to avoid distortion caused by perspective
from affecting the expression of the product's appearance design.
(4) Photos should avoid strong light, reflection, shadow, reflection, etc. that affect the expression of the product
’s appearance design.
(5) The products in the photos should usually avoid containing interior contents or foils.
But for products that must rely on interior contents or foils to clearly show the appearance of the product
>When designing, it is allowed to retain the interior or foil.

4?2?4 Defects in pictures or photographs
For patent applications with defects in pictures or photos, the examiner
A supplementary and correction notice or an examination opinion notice shall be issued to the applicant. According to Article 33 of the Patent Law, the applicant's modifications to the patent application document shall not exceed the scope of the original image or photograph. The defects mainly refer to the following items:
(1) There are errors in the view projection relationship, for example, the projection relationship does not comply with the orthographic projection rules
The projection relationship between views is inconsistent. Correspondence or the view direction is reversed, etc.
(2) The design pictures or photos are not clear, and the product graphics shown in the pictures or photos are too small; or although the graphics are clear, they are not clear due to strong light or reflection< /p>
Correct expression of light, shadow, reflection, interior contents or foils that affect product appearance design
(3) The product drawing lines in the design pictures contain lines that should be deleted or modified
, such as hatch lines, indicator lines, dotted lines, center lines, and dimensions in the view
Line, dot-dash line, etc.
(4) The views representing three-dimensional products have the following situations:
(i) The proportions of each view are inconsistent;
(ii) The key points of product design involve Six sides, and the six-sided orthographic view is insufficient,
Except for the following circumstances:
The rear view can be omitted when the rear view is the same as or symmetrical to the main view;
When the left view is the same as or symmetrical to the right view, the left view (or right view
picture) can be omitted;

If the top view is the same as the bottom view or is symmetrical, the top view (or bottom view
view) can be omitted;
The upward view may be omitted for large or fixed equipment and items with unusual undersides
(5) The views of flat products have the following situations:
(i) The proportions of each view are inconsistent;
(ii) The key points of product design involve Two sides, and two side front projection views are insufficient,
Except for the case where the rear view is the same or symmetrical as the main view and the rear view has no pattern
.
(6) For slender items such as measuring sticks, profiles, etc., the middle length is omitted when drawing, but two parallel double-dotted lines or natural fracture lines are not used. Disconnected
Drawing method.
(7) The cross-sectional view or the representation of the cross-section and the cut-off point have the following conditions
:
(i) The section line is missing or The section line is incomplete;
(ii) The cutting position line, symbol and direction indicating the cutting position are incomplete or missing
The above content (but does not need to be given to indicate the starting point from the center position) cut marks).
(8) There are partial enlargements, but the enlarged parts are not marked in the relevant views.
(9) A component product with a unique assembly relationship lacks a view of the combination state; a component product with no assembly relationship or a non-unique assembly relationship lacks the necessary individual components
View.
(10) In the appearance design of a transparent product, when the outer layer and the inner layer have more than two shapes, patterns and colors, they are not shown separately.
4?3 Brief explanation
Article 59, Paragraph 2 of the Patent Law stipulates that the scope of protection of design patent rights is expressed in the picture Or the appearance design of the product in the photo shall prevail. A brief description may be used to explain the appearance design of the product represented by the picture or photo.
According to Article 28 of the Implementing Rules of the Patent Law, the brief description should include
the following contents:
(1) Name of the design product . The product name in the brief description should be consistent with
the product name in the request.
(2) Purpose of design products. The brief description should include a purpose that helps define the product category. For products with multiple uses, the brief description should
state the multiple uses of the product described.
(3) Design points of appearance design. The key points of the design refer to differences from existing designs

< p>The shape, pattern and combination of other products, or the combination of color and shape, patternor location. Descriptions of design points should be concise and to the point.
(4) Specify a picture or photo that best expresses the key points of the design. Specified
pictures or photographs are used for publication in patent gazettes.
In addition, the following situations should be stated in the brief description:
(1) Situations in which color protection is requested or views are omitted.
If the design patent application requests color protection, it should be stated in the brief description
If the design patent application omits views, the applicant should usually state
the specific reasons for omitting the views, such as omitting due to symmetry or identity; if it is difficult
< p> If specified, you can also just state that a certain view is omitted. For example, if a large equipment lacks a bottom view,it can be written as "omitting a bottom view".
(2) If a design patent application is filed for multiple similar designs of the same product, one of them shall be designated as the basic design in the brief description.
(3) For flat products such as floral fabrics and wallpapers, the situation where the unit pattern in the flat product is continuous on two sides or continuous on four sides without defined boundaries should be described when necessary.
(4) For slender items, if necessary, the length of the slender item should be written using the
omission method.
(5) If the design of the product is made of transparent materials or new materials with special visual effects, it should be stated in the brief description when necessary.
(6) If the design product is a complete set of products, the product name corresponding to each
set should be stated when necessary.
The brief description must not use commercial promotional terms, nor can it be used to describe the performance and internal structure of the product
.
