What patent right has a protection period of 20 years?
Inventions are divided into inventions, utility models and designs. Patent right means that the patentee enjoys the exclusive right to use, benefit and dispose of his invention and creation within the scope prescribed by law, and excludes the interference of others. Article 42 of the Patent Law stipulates: "The term of the invention patent right is 20 years, and the term of the utility model patent right and the design patent right is 10 years, both of which are counted from the date of application". Therefore, the protection period of the invention patent right is 20 years, counting from the date of application.
