Obligations of the State Intellectual Property Office:
1. The obligation to fully disclose the content of the invention. The Patent Law stipulates that the scope of protection of an invention or utility model patent shall be based on the content of the claims. The description and drawings may be used to interpret the claims. The scope of protection of a design patent shall be subject to the design patent product shown in pictures or photos. If the patentee fails to fulfill this obligation, his invention will not be protected by law.
2. Obligation to pay annual fees. The patentee shall pay annual fees starting from the year when the patent right is granted. If the annual fee is not paid by the due date, the patent right will be terminated. However, Article 7 of the "Patent Law Implementing Rules" stipulates that if a party delays the time limit stipulated in the Patent Law or these Rules or the time limit designated by the Patent Administration Department of the State Council due to force majeure, resulting in the loss of its rights, 2 days from the date when the obstacle is eliminated Within 2 months, or at the latest 2 years from the expiration date, the applicant may request the restoration of rights by explaining the reasons to the patent administration department of the State Council and attaching relevant supporting documents. If a party delays the time limit stipulated in the Patent Law or these Rules or the time limit specified by the Patent Administration Department of the State Council due to legitimate reasons, resulting in the loss of its rights, the party may file a request with the Patent Administration Department of the State Council within 2 months from the date of receipt of the notice from the Patent Administration Department of the State Council. Explain the reasons and request restoration of rights. If a party requests an extension of the time limit specified by the patent administration department of the State Council, it shall explain the reasons to the patent administration department of the State Council and go through relevant procedures before the expiration of the time limit.
