According to Article 6 of the Measures for the Registration of Computer Software Copyright, the National Copyright Administration recognized China Copyright Protection Center as the software registration agency. With the approval of the National Copyright Administration, China Copyright Protection Center may set up local software registration offices.
Article 10 Inquirers of software registration files shall inquire in the following ways:
(a) through the center website bulletin board query;
(two) the software registration electronic file query;
(3) The original file query of the software registration manuscript.
Handle the inquiry procedures in accordance with the following provisions:
(1) If a natural person, legal person or other organization handles an inquiry, it shall fill in an inquiry application form and handle it with an identity document, work permit or letter of introduction from the unit. If a software registrant inquires about or copies its own registration documents, it shall also submit the original software registration certificate.
(two) the judicial organs to inquire, copy and borrow the registered official files, the undertaker shall fill in the inquiry application form, and handle it with the unit's letter of introduction or official letter and work permit. Copying and borrowing registered files must be signed and agreed by the person in charge of the software registration department of the center and the competent leader of the center.
(3) If the staff of the central software registration department need to consult and borrow the registered files because of their work, they should fill in the Application Form for Borrowing Files and handle it after being signed by the person in charge of the software registration department.
Article 12 An inquiry object shall comply with the following provisions:
(a) the inquirer shall, accompanied by the archivist, read or extract the registered archives in the inquiry window area of the registration hall. Copying paper original registration files and printing electronic registration files should be completed by the file administrator.
(two) personnel who inquire about the registration files of the original paper software are prohibited from modifying, smearing or marking the file materials.
(three) in violation of the above provisions, the archives management personnel shall stop and correct it; Refuses to correct, can refuse to provide the query; If losses are caused, the inquirer shall be liable for compensation.
Article 13 The Center shall, within ten working days from the date of accepting the inquiry, give a written reply to the application that meets the inquiry conditions.
Payment standard of inquiry fee:
(1) query fee for computer information base:
A, question bank query: search a software directory in the registry.
Information in the last five years: 100 yuan per question, and 0.30 yuan per question if it exceeds 100;
Retrospective inquiry (5 years ago): 0.50 yuan for each question 150 yuan, exceeding 100.
B, abstract library query: query a brief abstract of a software.
Information in the last five years: 20 yuan for each question, more than 3 pages, 0.50 yuan per page.
Retrospective inquiry (5 years ago): 30 yuan per question, more than 3 pages, 0.50 yuan per page.
C. copyright investigation and inquiry: inquire about the copyright of a certain software.
Information in the last five years: 200 yuan for each question, more than 3 pages, 0.50 yuan per page.
Retrospective inquiry (5 years ago): 250 yuan per question, more than 3 pages, 0.50 yuan per page.
(2) The paper media inquiry fee refers to the files with the specified registration number, and each file charges 2 yuan. If photocopying is required, a photocopying fee will be charged.
