Patent late payment fee refers to the extra expenses incurred by the patentee who fails to pay the annual patent fee on time and then pays the annual patent fee. This fee is called patent late fee, and the longest patent late fee is 6 months.

Patent late fee algorithm

1. Failing to pay the annual patent fee within the prescribed time limit. If it exceeds 1 month, including this month, you need to pay the annual fee, and you don't need to pay the late fee;

2. The annual patent fee is not paid within the prescribed time limit and exceeds 1 month to 2 months, including 2 whole months. Need to pay an annual fee and pay a late fee of 5% of the full annual fee;

3. If the patent annual fee is not paid within the prescribed time limit, if it is more than 2 months to 3 months (including 3 whole months), the annual fee shall be paid, and a late fee of 10% of the full annual fee shall be paid;

4. If the patent annual fee is not paid within the prescribed time limit and exceeds 3 months to 4 months (including 4 whole months), the annual fee shall be paid, and a late fee of 15% of the annual fee shall be paid;

5. If the annual patent fee is not paid within the prescribed time limit, and it is more than 4 months to 5 months (including 5 whole months), the annual fee shall be paid, and a late fee of 20% of the full amount of the whole year shall be paid;

6. If the patent annual fee is not paid within the prescribed time limit, if it is more than 5 months to 6 months (including 6 whole months), the annual fee shall be paid, and a late fee of 25% of the full amount of the whole year shall be paid;

Payment method of annual fee

Patent fees can be paid online, by mail or bank remittance, or in person in China National Intellectual Property Administration.

Online payment: users who apply for electronic registration can log in according to relevant requirements and use the online payment system to make payment.

When remitting money, you should prepare the application number, fee name (or abbreviation) and detailed amount. If the application number and fee name (or abbreviation) are not specified, it shall be regarded as the guardian who has not paid the fee. If remittance is made through the post office, the remitter's name and mailing address (including postal code) should also be indicated on the remittance slip. If the fee cannot be refunded due to the incomplete or inaccurate information of the payer, it shall be deemed that the payment procedures have not been handled.
