How to apply for patent priority examination?

Patent priority examination can be carried out in the following ways.

(a) the provincial bureau accepts the priority review method. The applicant may submit to the Provincial Intellectual Property Office a request for priority review of an application for a patent for invention and other materials required for priority review in duplicate, and the Provincial Intellectual Property Office shall verify whether it meets the conditions for priority review and then forward it to China National Intellectual Property Administration for review.

(II) Acceptance and reply The Provincial Intellectual Property Office shall review and reply the priority review request according to the quota and merit-based principle of China National Intellectual Property Administration, and the processing time of the Provincial Bureau shall be 10 working day.

(III) Submission of materials to the State Patent Application Bureau The State Bureau of Justice usually issues an audit opinion to the applicant on whether or not to agree to the priority review within 3 to 5 working days from the date of receiving the priority review request. For patent re-examination and patent invalidation cases, after receiving the request for priority review, the request will be reviewed as soon as possible, and the corresponding notice will be issued to inform the requester whether to enter the priority review procedure.
