Publishing false housing advertisements in newspapers, street flyers or some websites is the most common fraudulent means of black intermediaries. The form of expression is to introduce some houses with good lots and conditions in advertisements, but the rent is very low, attracting renters. Once the renter expresses his willingness to rent a house, the black intermediary will say that the announced house has been rented out, and then recommend a house with poor conditions and high rent to defraud the room fee, information fee or force the tenant to submit.
(2) the trap of arbitrary charges.
The problem of arbitrary charges has always been the patent of black intermediaries and small intermediaries. There are many reasons for charging, such as room fees, information fees and consulting fees. There are various forms of expression. Under normal circumstances, when the renter entrusts these black intermediaries to find a house, the staff of these black intermediaries will immediately claim to have a suitable house, but they must pay a so-called deposit ranging from several hundred yuan to thousands of yuan first, on the grounds that they will not leave the intermediary after meeting the tenant and landlord. And once you ask their staff to accompany you to see the house, they usually say that the landlord can't come because of something, or show you some houses that you can't accept at all. And then put it off. In short, the deposit is not refunded, and even violent means such as intimidation and force are used to let the renter return. Some black intermediaries don't have a house in their hands, and they abscond with money after defrauding enough money. This kind of quick decision to change a place with one gun has brought great difficulties to renters to ask for a deposit and solve the case.
(3) the fake landlord trap.
The common false landlord trap is that the swindler rents the house, then pretends to be the landlord to sublet the house, and finally absconds with the money, which brings huge economic losses to the renter.
2. What are the ways to terminate the house lease contract?
The exercise of the right to terminate the housing lease contract has two forms: agreed termination and legal termination:
(1) The agreed termination of a house lease contract means that the parties to the contract think that it is more beneficial to their own interests to terminate the contract than to continue to perform the contract, and according to the principle of freedom of contract, they terminate the contract through consensus. In this regard, Article 93 of China's Contract Law stipulates: "The parties may terminate the contract through consultation. The parties may stipulate the conditions for one party to terminate the contract. When the conditions for termination of the contract are met, the creditor may terminate the contract. "
(2) The legal rescission of the house lease contract refers to the right and obligation of one party to terminate the contract by exercising the right of rescission in accordance with the law when the situation stipulated by law occurs.
According to Article 94 of China's Contract Law, the parties may terminate the contract under any of the following circumstances:
1. The purpose of the contract cannot be achieved due to force majeure;
2. Before the expiration of the performance period, one party clearly indicated or indicated by its own behavior that it would not perform the main debt;
3. One party delays the performance of the principal debt and fails to perform it within a reasonable period after being urged;
4. One party delays the performance of debts or has other behaviors, which makes the purpose of the contract impossible to achieve;
5. Other circumstances stipulated by law.
Renting houses is common now, and many citizens have idle properties. It is also common for outsiders to rent alone or share. This breeds the role of "second landlord" who rents the house and sublets it. Some are criminals who use loopholes to deceive landlords and tenants. If you encounter such a problem, I suggest you seek the help of a professional lawyer as soon as possible.
