Article 5 The support plan implements a confidentiality system, avoidance system, credit management system and publicity system. Article 6: The Ministry of Science and Technology (hereinafter referred to as the "Ministry of Science and Technology") shall establish a national science and technology plan management information system, strengthen the information management of national science and technology plans, and promote the rational allocation and sharing of science and technology resources.
Article 7: The Ministry of Science and Technology shall work with the Ministry of Finance to formulate management measures for support plans. The Ministry of Science and Technology is responsible for supporting the organization and implementation of the plan, with two levels: projects and topics. The project adopts a management method of limited goals, classified guidance, rolling project establishment, and annual implementation, with an implementation cycle of three to five years. Article 8 The Ministry of Science and Technology is responsible for the organization, management and supervision of the overall implementation of the support plan. Its main responsibilities are:
(1) Responsible for the overall design and development strategy research of the support plan;
(2) Formulate relevant management measures;
(3) Establish a database of alternative projects for the national science and technology plan, summarize and propose project proposals, determine project organizational units, organize project feasibility studies, and approve project approval;< /p>
(4) Prepare annual plans;
(5) Guide and supervise the implementation of support plans, coordinate and deal with major issues in project execution;
(6) ) Organize project acceptance;
(7) Summarize the scientific and technological achievements produced by registered projects and strengthen management in accordance with regulations.
(8) Establish a national science and technology plan management information system.
Article 9 The project organizing unit is the relevant departments (units) of the State Council, relevant local science and technology departments (committees, bureaus) and other units or organizations with organizational and coordination capabilities. They are responsible for the completion of project goals and implementation effects. , whose main responsibilities are:
(1) Organize and prepare the project feasibility study report as required;
(2) Responsible for the task decomposition of the project, organize the feasibility study of the subject, and follow the " Based on the principle of "openness, fairness and impartiality", select the best to determine the project undertaking unit and the unit responsible for the final technology or product integration of the project, and organize the signing of the project task letter;
(3) Implement the agreed payment of the project in addition to financial funds Funds from other channels and related guarantee conditions;
(4) Organize the implementation of projects (topics), supervise and inspect the implementation of topics and the use of funds, summarize and report the annual implementation of projects and related Information reports, coordinate and handle relevant issues that arise during the implementation of the project (topic);

Article 10 The units responsible for the project are enterprises, scientific research institutes, universities, etc. that have strong scientific research capabilities and conditions, standardized operation and management, are registered in mainland China, and have independent legal person status. According to The legal person management responsibility system requires the person to be responsible for the completion of project tasks and implementation results. The main responsibilities are:
(1) Prepare the project mission statement according to the project feasibility study report;
(2) In accordance with the tasks determined in the signed project mission statement, organize the research team, implement self-financed investment and relevant guarantee conditions, and complete the project's scheduled goals;
(3) Manage and use project funds in accordance with regulations;< /p>
(4) Prepare and report the annual implementation of the project and relevant information reports as required, promptly report major problems that arise during the implementation of the project, and submit all documents and materials for project acceptance;
(5) Sign an agreement with each participating unit before the implementation of the project to clarify the ownership of the intellectual property rights and results generated during the implementation of the project, and protect the rights and interests of all parties in accordance with relevant policies and regulations.
Article 11: Give full play to the consulting role of experts in the project establishment, implementation supervision, acceptance, and budget budget of the support plan; experts participating in the support plan are randomly selected from the national science and technology plan expert database. Experts are responsible for the fairness and scientificity of consultation results; establish and improve expert selection, use, avoidance and credit systems.
Article 12: Science and technology service agencies accept entrustment to carry out patent novelty checking, evaluation, process management and other work, and are responsible for the scientificity and fairness of the work results. Article 13 Basic requirements for the establishment of a support plan:
(1) Meet the positioning and support focus of the support plan;
(2) The project goals and tasks are clear and specific, and the technical indicators can be assessed , can be completed in three to five years, and can form results or related technical standards with independent intellectual property rights;
(3) The preliminary research foundation of the project is good, the organizational implementation mechanism and supporting conditions are guaranteed, and the implementation plan And the allocation of funds is reasonable, scientific and operable;
(4) It can drive the development of talents and bases, and the results can be transformed and applied after the completion of the project.
Article 14 The Ministry of Science and Technology shall, in accordance with national goals and strategic priorities, strengthen top-level design and overall layout, determine annual support priorities and issue guidelines for soliciting alternative projects, in conjunction with relevant departments of the State Council, local science and technology departments (committees) , bureaus), national industry associations, industrial technology innovation strategic alliances and other scientific and technological needs, establish and improve the national science and technology plan alternative project library. The pool of alternative projects is the primary source for annual planning preparation.
Article 15 The Ministry of Science and Technology organizes experts to review alternative projects through online video. For projects with important research content, clear research goals, feasible technical routes, strong research teams, and good research foundations and conditions, Select the best items for storage.
Article 16 The Ministry of Science and Technology shall, in accordance with the key areas and priority themes determined in the "Outline", combined with the key tasks determined by the national five-year science and technology plan, the five-year science and technology special plan, inter-ministerial cooperation, ministerial and provincial consultations, etc. , work with departments, localities and relevant parties to condense and integrate from the alternative project library and put forward alternative project suggestions that meet the annual support priorities.
Article 17: The Ministry of Science and Technology organizes experts to conduct comprehensive consultation on the proposed alternative project suggestions, and determine the project approval project, project organization unit, etc.
Article 18: The project organization unit shall organize the preparation of the project feasibility study report, and propose the specific project goals, task breakdown, project implementation and operation mechanism, etc.
Article 19: The project organization unit selects the best from the Ministry of Science and Technology's alternative project library to determine the project undertaking unit based on the demonstration opinions; for projects with clear goals and tasks and the project undertaking unit has particularly obvious advantages, targeted entrustment can be adopted method to determine the unit responsible for the subject. The proportion of financial funds for the project undertaken by units outside the project organization unit system shall, in principle, be no less than 40%.
Article 20: For projects (topics) with clear product orientation and industrialization prospects, enterprises should be the main implementation entities, with enterprise investment as the main input.
Conditions for enterprises to undertake or participate in projects (topics):
(1) Meet the basic conditions required by the unit undertaking the project;
(2) Projects (topics) jointly implemented by industry, academia and research institutes, Enterprises should sign legally binding agreements with other institutions in advance to clarify the division of tasks, ownership of intellectual property rights, and profit distribution mechanisms;
(3) Ground-breaking technological achievements obtained through the implementation of projects (topics) , enterprises are obliged to spread to the industry through various methods;
(4) Their self-raised funds should be no less than state-appropriated funds.
Article 21: Encourage industrial technology innovation strategic alliances to apply for, organize and undertake support plan projects.
Article 22: The Ministry of Science and Technology shall, in accordance with the financial budget management requirements, formulate project (topic) budget arrangement proposals and submit them to the Ministry of Finance for approval.
Article 23: The Ministry of Science and Technology approves the project establishment. Based on the approval opinions, the project organization unit signs a project assignment letter with the project undertaking unit, which will be implemented after review by the Ministry of Science and Technology.
Article 24: Establish an emergency response mechanism to support the plan. For emergencies that affect the development of the national economy and society, if there are urgent and major scientific and technological needs, the Ministry of Science and Technology may consult with relevant departments and localities to directly demonstrate the project and organize its implementation.
Article 25 The feasibility study of the project (topic) should include intellectual property analysis as an important content, and submit the distribution and development trends of intellectual property rights in this technical field and the research and industry of this project (topic) Analytical reports on intellectual property countermeasures, etc., regard the acquisition of independent intellectual property rights as one of the important assessment objectives of the project (topic).
Article 26: The support plan takes the formation of technical standards as one of the important goals of organizing and implementing projects (topics). Priority will be given to supporting technical standard projects (topics) that are urgently needed for the country's economic and social development, can significantly improve the international competitiveness of the industry, and form important technical trade measures in my country.

Article 28: Establish a publicity system. Under the premise of complying with national confidentiality regulations, information such as the establishment of projects (topics) will be disclosed to the public in a timely manner.
Article 29: It is strictly prohibited to apply for the same project (topic) repeatedly in different national science and technology plans, public welfare industry scientific research projects, etc. For duplicate applications and subject application units that commit fraud or forge application materials or certification materials, once discovered, relevant provisions on credit management will be followed. Article 30: The project organization unit is responsible for the specific organization and implementation of the project. In accordance with the project approval requirements and the project mission statement, inspect, supervise and implement the relevant guarantee conditions of the project (topic) to ensure that the project (topic) is executed as planned.
Article 31: Support the implementation of an annual reporting system for planned projects. The unit responsible for the project prepares an annual plan implementation report and submits relevant information statements as required. The project organizing unit summarizes and submits it to the Ministry of Science and Technology before November 15 of each year; projects with an implementation period of less than three months in the current year can be reported together in the next year. . The annual report is an important basis for the adjustment, cancellation and appropriation of projects (topics) in the next year.
Article 32: Strengthen the management, supervision and evaluation of project (topic) implementation. The Ministry of Science and Technology entrusts relevant public institutions or third-party science and technology service agencies to conduct independent evaluation and supervision of project (topic) implementation, organizational management, implementation of guarantee conditions, fund management, expected prospects, etc. Project process management implements the project specialist system. For projects that are implemented around major national tasks, methods such as setting up project specialists or expert groups can be used to strengthen project implementation process management. Specific implementation shall be in accordance with relevant regulations.
Article 33 If the following circumstances occur during the implementation of the project (topic), it shall be adjusted or canceled in a timely manner:
(1) There are major changes in market, technology, etc., As a result, the original goals and technical routes of the project (topic) need to be modified;
(2) Self-raised funds or other conditions cannot be implemented, affecting the normal implementation of the project (topic);
(3) ) The engineering construction or equipment development on which the project (topic) relies can no longer be implemented;
(4) Major changes in technology introduction, international cooperation, etc. have caused the research work to be unable to be carried out;
(5) The technical backbone of the project (topic) has undergone major changes, causing the research work to be unable to proceed normally;
(6) Due to other irresistible factors, the research work cannot be conducted normally.
Article 34: For projects (topics) that need to be adjusted or canceled, the project organizing unit shall submit written opinions and report them to the Ministry of Science and Technology for approval before implementation. When necessary, the Ministry of Science and Technology can directly make adjustments based on implementation status, evaluation opinions, etc.
Article 35: For projects (topics) planned to be canceled, the project organizing unit shall make a written report on the work carried out, use of funds, purchased equipment and instruments, phased results, intellectual property rights, etc. , and report to the Ministry of Science and Technology for verification and filing.
Article 36: Projects (topics) accept the guidance, inspection and supervision of organizational management or implementation departments, third-party scientific and technological service agencies, project specialists, etc.
Article 37: The support plan implements a responsibility investigation system, and the corresponding responsibilities of the personnel and units involved in the management and implementation of the plan for violations of regulations and disciplines are held accountable.
(1) For managers who have neglected their duties, abused power for personal gain, committed fraud, etc., once verified, they will be criticized and educated depending on the severity of the case, or the disciplinary inspection and supervision department will give them administrative (disciplinary) sanctions in accordance with relevant regulations. .
(2) For scientific research misconduct such as fraud, malpractice for personal gain, plagiarism of other people’s scientific and technological achievements discovered during the project (topic) application, review, execution and acceptance process, as well as illegal operations or failure to do so due to subjective reasons Scientific research units or individuals who are unable to complete the project tasks and cause losses will, upon verification, be notified of criticism, terminate the project (topic) tasks and recover special funds, and be disqualified from applying for national science and technology plan tasks within a certain period of time, depending on the severity of the case; If it constitutes a violation of discipline, the disciplinary inspection and supervision department will impose administrative (disciplinary) sanctions in accordance with relevant regulations.
(3) For projects (topics) that do not submit annual report materials or information on time, and do not accept supervision and inspection as required, the Ministry of Science and Technology may take measures such as delaying, reducing, or suspending funding, and require The project organizing unit and the project undertaking unit shall make rectifications within a time limit. Projects (topics) that fail to be rectified will be punished by notifying them of criticism, recovering the allocated funds, and disqualifying them from participating in support plan activities within a certain period of time, depending on the circumstances.
Article 38 Strengthen credit management, objectively record the credit status of project organizing units, project undertaking units and project responsible persons, experts, scientific and technological service agencies, etc. in the implementation of support plans, and use them as other An important basis for participating in national science and technology plan activities. Article 39: The Ministry of Science and Technology organizes the acceptance of support plan projects. Project acceptance is based on the task assessment indicators determined in the project approval; the project acceptance work should be completed within half a year after the end of the specified execution period.
Article 40: If the project still cannot be accepted for acceptance six months after the end of the implementation period, the Ministry of Science and Technology will notify the relevant units or responsible persons. If the project cannot be completed on time for any reason, the project organization unit should apply for an extension three months in advance, and the new plan will be implemented after approval by the Ministry of Science and Technology; if approval is not obtained, the project still needs to be accepted according to the original deadline.
Article 41: The acceptance work can be carried out by organizing an expert group or entrusting a scientific and technological service agency with corresponding qualifications. According to the characteristics of the project, various methods such as meeting review and acceptance, online review and acceptance, and on-site assessment and acceptance can be used to formulate acceptance conclusions.
Article 42: The acceptance conclusion of the support plan project is divided into passing acceptance and failing acceptance.
(1) The project goals and tasks have been completed in accordance with the assessment indicators and the funds have been used reasonably, which means it has passed the acceptance.
(2) Any one of the following conditions will not pass the inspection:
1. Less than 85% of the project goals and tasks have been completed;
2. The acceptance documents, information, and data provided are untrue and contain fraud;
3. Without application or approval, the project undertaking unit, project leader, assessment indicators, research content, technical route, etc. are changed;
4. It has not been completed for more than six months beyond the implementation period stipulated in the project approval, and no explanation has been given in advance;
5. There are serious problems with the use of funds.
Article 43: The acceptance opinions are more controversial due to incomplete or inaccurate acceptance documents provided, or the project results and information are not archived and organized as required, or the research process and results If there is a dispute that has not yet been resolved, reconsideration is required. For projects that require review, acceptance should be organized again within six months after the first acceptance, after improvements have been made or additional materials have been made to address existing problems. If improvements or supplementary materials are not made within the specified time limit, it will be deemed to have failed the acceptance.
Article 44: The Ministry of Science and Technology shall notify the project organization unit in writing of the project acceptance conclusion. In addition to confidentiality requirements, project acceptance conclusions and results should be disclosed to the public.
Article 45: For projects that fail to pass the acceptance inspection, the Ministry of Science and Technology will notify the relevant units or responsible persons. Among them, those who fail to pass the acceptance due to violation of relevant policies, regulations and science and technology plan management systems will be disqualified from undertaking support plan projects within five years. Article 46: Strengthen the management and protection of support plan results and intellectual property rights, and encourage the transfer and transformation of support plan results. The results achieved by the support plan must be registered and managed in accordance with the "Registration Measures for Scientific and Technological Achievements" and other relevant regulations. The management of intellectual property rights supporting the plan and the ownership and distribution of interests generated by the intellectual property rights are in accordance with the "Science and Technology Progress Law of the People's Republic of China" and the "Several Provisions on the Management of Intellectual Property Rights of Research Achievements of National Scientific Research Plan Projects" by the General Office of the State Council. and the Ministry of Science and Technology's "Regulations on Strengthening the Management of Intellectual Property Rights in National Science and Technology Plans" and other implementations.
Article 47: The support plan shall encourage and guide the integrated demonstration and transformation application of the results that form technical standards in accordance with the requirements of the "Implementation Rules for Science and Technology Plans to Support the Research and Application of Important Technical Standards".
Article 48: Projects and results involving state secrets shall be implemented in accordance with the "Regulations on Science and Technology Confidentiality".
Article 49: The project organization unit and the project undertaking unit shall, before the project and project are launched, enter into a formal agreement with each participating unit to agree on the distribution of results and intellectual property rights, and shall not maliciously monopolize the results. and intellectual property rights. If the project organization unit and the project undertaking unit violate the agreement on the distribution of results and intellectual property rights, they will not be allowed to participate in the support plan within five years.
Article 50: Strengthen the publicity of support plans. The publicity and promotion of technologies, products, patents, standards and other achievements formed by the support plan should be marked with the words "National Science and Technology Support Program Funding" and the project number, and serve as the basis for confirmation during evaluation or acceptance.
Article 51: Establish standardized and sound project scientific data and scientific and technological report files, and establish a mechanism for the exchange and sharing of project scientific and technological resources. Project organizing units and project undertaking units shall report project (topic) related data and results on time in accordance with national regulations on the sharing of scientific data. Establish and improve the data and results database of supporting planned projects to realize information disclosure and resource sharing. Article 52: Management measures for support plan funds will be formulated separately.
Article 53: These Measures shall come into effect on the date of promulgation, and the original "Interim Measures for the Administration of National Science and Technology Support Programs" (Guoke Fa Ji Zi [2006] No. 331) shall be abolished at the same time.
