Does the PCT patent application submission language have to be English?
Must the submission language of PCT patent application be English? Patent Cooperation Treaty (PCT) is an international treaty with more than 150 States parties. When filing an international patent application through PCT, the applicant can seek the protection of his invention in these contracting States at the same time. So, how to submit a PCT patent application? Do PCT patent application documents have to be submitted in English? PCT patent application is divided into international phase and national phase. Among them, the application, international retrieval and international publication are completed in the international stage (if the applicant requests, the international stage also includes preliminary examination procedures). Whether the patent right is granted or not is completed at the national stage by the designated/selected national bureau. So, in which languages can PCT patent applications be submitted? The applicant may file an international patent application in any language accepted by the receiving office. If the language in which the application is submitted is not the language accepted by the international retrieval organization, the applicant needs to provide a translation of the international retrieval application. However, each receiving office must accept applications submitted in at least one language that meets the following conditions: not only the languages accepted by international search agencies (Chinese, English, German and Japanese, but also French, Korean, Russian and Spanish in some cases), but also the "publishing language" (that is, the languages used to publish international patent applications: Arabic, Chinese, English, French, German and Spanish). Therefore, the applicant can always choose at least one of the above languages to file an international patent application without submitting a translation for PCT international retrieval or publication.
