In order to further improve the housing security system and speed up the solution to the housing difficulties of urban low-income families, according to the Opinions of the State Council on Solving the Housing Difficulties of Urban Low-income Families (Guo Fa [2007] No.24), the Opinions of the People's Government of Hebei Province on Improving and Implementing the Urban Housing Security System to Effectively Solve the Housing Problems of Low-income Families (Zheng Ji [2007] No.95), the Ministry of Construction and other nine ministries and commissions, the Measures for Ensuring Low-rent Housing (Decree No.650)

I. Guiding ideology and general requirements

(1) guiding ideology. We should thoroughly implement the spirit of the 17th CPC National Congress and Scientific Outlook on Development under the guidance of Deng Xiaoping Theory and Theory of Three Represents. According to the goal of building a well-off society in an all-round way and building a harmonious society, solving the housing difficulties of urban low-income families should be regarded as an important task to safeguard the interests of the masses and an important part of the housing system reform, and as an important responsibility of the government to provide services. Accelerate the establishment and improvement of a housing security system that focuses on the low-rent housing system and solves the housing difficulties of urban low-income families through multiple channels.

(2) General requirements. Taking urban low-income families as the object, we will further improve and perfect the low-rent housing system, improve and standardize the construction of affordable housing, intensify the transformation of old residential areas and shanty towns (dilapidated houses), and strive to improve the housing conditions of urban low-income families by the end of the Eleventh Five-Year Plan.

3. The per capita housing construction area of the family is below 15 square meters, and the total housing construction area of the family is below 50 square meters.

(6) Reasonably determine the standards and methods of guarantee.

The guarantee standard is per capita housing construction area 15 square meters, the minimum guarantee standard is 30 square meters per household, and the maximum guarantee standard is 50 square meters. The guarantee method is mainly to issue monetary subsidies for rental housing, supplemented by physical distribution and rent reduction.

Monetary subsidy means that local people's governments at or above the county level grant rental housing subsidies to urban low-income families with housing difficulties who apply for low-rent housing security, and they rent their own houses. The amount of subsidy is determined according to the difference between the existing housing area and the standard of security area of urban low-income families with housing difficulties and the standard of rental housing subsidy per square meter.

Shiwupeizu means that local people's governments at or above the county level provide housing to urban low-income families with housing difficulties who apply for low-rent housing security, and collect rent according to the prescribed standards. The rent standard of low-rent housing shall be approved by the price management department in conjunction with the housing security and real estate management department at the same level, implemented after approval by the government at the same level, and reported to the price management department of the government at the next higher level and the housing security and real estate management department for the record.

For the minimum living guarantee families in the low-rent housing system, if they enjoy the rental housing subsidy, they will be fully subsidized within the guarantee standard; Enjoy shiwupeizu, rent-free in full within the guarantee standard.

Shiwupeizu area is the difference between the existing housing area of urban low-income families with housing difficulties and the standard of security area. Shiwupeizu housing mainly adopts new affordable housing and low-rent housing in ordinary commodity residential quarters, purchasing standard stock housing and vacating public housing. The basic standard of low-rent housing is a single building area of not less than 30 square meters and not more than 50 square meters.

Enjoy the low-rent housing system does not include water, electricity, heating, gas, property and other costs.

(seven) the implementation of low-cost housing security funds. The main source of security funds:

1. The net income from land transfer is not less than 10%, and the proportion can be further appropriately increased according to the actual situation;

3. Financial general budget funds;

5. Funds raised by social donations and other means.

When making budget arrangements every year, the municipal finance should use all the first two funds raised for the construction of low-rent housing system. If it is insufficient, some funds will be arranged from the general budget to make up for it. Low-rent housing security funds to implement financial accounts management and project budget management, housing security management departments should be in accordance with the provisions of the financial department at the same level, the preparation of the project expenditure budget, and in accordance with the budget approved by the financial department at the same level.

(eight) to apply for low-cost housing system security according to the following procedures:

1, application

Families applying for low-rent housing security must meet the low-rent housing security conditions determined by the government in that year. The head of the household shall submit a written application to the subdistrict office and township (town) people's government where the household registration is located, and provide the following materials:

(1) proof of family income;

(2) proof of family housing status;

(3) family members' ID cards and household registration books;

(4) Other supporting materials.

Step 2 review

(1) preliminary examination: the subdistrict office and the township (town) people's government shall, within 30 days from the date of accepting the application, review whether the applicant's family income and family housing conditions meet the prescribed conditions, put forward preliminary examination opinions and publish them in the neighborhood Committee (community) where they are located, and submit the preliminary examination opinions and application materials to the district (county) housing security management department;

(2) Audit: The district (county) housing security management department shall, within/0/5 days from the date of receiving the application materials, put forward audit opinions on whether the applicant's family housing situation meets the prescribed conditions, and forward the qualified applicant's application materials to the civil affairs department at the same level. The civil affairs department of the district (county) shall, within 15 days from the date of receiving the application materials, put forward audit opinions on whether the applicant's family income meets the prescribed conditions, and feedback to the housing security management department at the same level.

Step 3 publicize

After examination, if the family income and family housing conditions meet the prescribed conditions, the district (county) housing security management department shall collect the relevant information of the applicant and report it to the municipal housing security and real estate management department, which shall publicize the relevant information of the eligible applicant for 15 days. Do not meet the conditions, notify the applicant in writing and explain the reasons. If the applicant disagrees with the audit results, he may appeal to the municipal housing security and real estate management department. City housing security and real estate management departments shall promptly accept the complaints of the parties, and verify the situation and reply.

Step 4 agree

If there is no objection to the publicity or the objection is not established, the municipal housing security and real estate management department shall register the low-rent housing security object.

For families who meet the conditions of low-rent housing security, the municipal low-rent housing and affordable housing management center will sign a housing subsidy agreement or a low-rent housing lease contract with them.

The agreement or low-cost housing lease contract shall contain the following contents:

(1) The location, orientation, area, structure and ancillary facilities of the house;

(2) Rent and its payment method;

(three) the purpose and use requirements of the house;

(4) Term of lease;

(5) Responsibility for house maintenance;

(VI) Stop the distribution of rent in kind, including the lessee failing to meet the prescribed conditions, lending, subletting or changing the use of the rented low-rent housing, failing to live in the rented low-rent housing for more than 6 months without justifiable reasons or failing to pay the low-rent housing rent;

(seven) the liability for breach of contract and dispute resolution methods, including returning low-rent housing, adjusting rent, and handling in accordance with relevant laws and regulations;

(8) Other agreements.

Shiwupeizu should give priority to families with special difficulties such as orphans, the elderly, the sick and the disabled who have been registered as low-rent housing security objects, families with minimum living security for urban residents and other families in urgent need of assistance. Other low-rent housing listings are arranged from low to high according to the current housing area of the applicant family, and the same conditions are determined by lottery.

Due to the payment of rental housing subsidies and low-rent housing, the confirmed housing was publicized twice in the neighborhood Committee (community).

Step 5 manage

Urban low-income families who enjoy the treatment of low-rent housing shall not lend, sublet or change the use of the rented low-rent housing. If you have not lived in rented low-rent housing for more than 6 months without justifiable reasons or have not paid the rent of low-rent housing for more than 6 months without justifiable reasons, you should return the low-rent housing in accordance with the contract. Failing to return low-rent housing in accordance with the contract, the housing security management department shall order it to return within a time limit. If it is overdue, the rent can be adjusted according to the contract. Refuse to accept the above provisions, by the housing security management department or by the low-cost housing and affordable housing management center in accordance with relevant laws and regulations.

Third, improve and standardize the management of affordable housing

(9) Affordable housing refers to the policy-oriented housing that the government provides preferential policies, limits the area and sales price of Xing Tao, is built according to reasonable standards, and is supplied to urban low-income families with housing difficulties.

2. The per capita disposable income of the family is lower than 0.8 times (inclusive) of the per capita disposable income of the previous year determined locally;

3. The per capita housing construction area of the family is below 15 square meters, and the total housing construction area of the family is below 50 square meters.

Families who have participated in welfare housing distribution in the past may not purchase affordable housing before returning to the housing reform, and families who have purchased affordable housing may not purchase affordable housing again.

(thirteen) the implementation of affordable housing development and construction project approval system. City housing security and real estate management department in conjunction with the relevant departments of the city, according to the project reserve and the annual land use plan, formulate affordable housing construction projects in different years, with the consent of the municipal government and complete the necessary preparatory work such as the feasibility study report of the project, and report it to the Provincial Construction Department for approval step by step.

(fourteen) the construction of affordable housing in accordance with the principle of government organization and coordination, market operation, you can take the way of project legal tender, choose a real estate development enterprise with corresponding qualifications and good social responsibility. Can also be directly organized by the city low-cost housing and affordable housing management center. In the construction of affordable housing, we should pay attention to the positive role of large state-owned backbone construction enterprises.

Take the project legal tender affordable housing projects, preliminary work by the municipal housing security and real estate management department is responsible for. After the preliminary work is completed and approved by the Provincial Construction Department, the municipal housing security and real estate management department will organize the project legal person bidding.

The bidding documents shall include the contents of construction, construction standards, construction period, construction quality, sales price, etc. The bidding price is determined by the price management department of the municipal government in conjunction with the municipal housing security and real estate management department in accordance with the provisions of the Measures for the Administration of Affordable Housing Prices.

If the price of newly-built affordable housing is not determined and announced before the start of construction, the real estate development and operation enterprise or the city low-rent housing and affordable housing management center shall, before the sale of affordable housing, calculate the housing cost and put forward a written application for pricing, report it to the municipal price department for determination, and announce it to the public.

After obtaining the qualification of project legal person, a real estate development enterprise shall go through the relevant formalities in accordance with the basic construction procedures.

The winning bidder entrusts an intermediary agency with corresponding engineering consulting qualification to prepare a project application report, and reports it to the municipal development and reform department for approval or the provincial development and reform department for approval according to procedures. When the project meets the construction conditions, it shall declare the annual investment plan for the construction of affordable housing to the municipal development and reform department, and go through the commencement formalities with the annual investment plan for the construction of affordable housing.

Real estate development enterprises shall not engage in other types of real estate development in disguise after acquiring land in the name of affordable housing. Otherwise, cancel its qualification for the development of affordable housing projects and recover the land use right.

(fifteen) strictly control the construction standards. For the affordable housing projects that have obtained the construction land planning permit after the issuance of the Opinions of the State Council on Solving the Housing Difficulties of Urban Low-income Families (Guo Fa [2007] No.24) on August 10, 2007, the construction area of a single affordable housing should be controlled below 65 square meters (inclusive).

The planning and design unit of affordable housing shall carry out planning and design in accordance with the standards stipulated in the construction of affordable housing.

For projects that do not meet the construction area standard of a single set of affordable housing, the planning management department shall not issue a construction project planning permit, the construction drawing review agency shall not issue a review certificate, and the construction management department shall not go through the formalities for the review and filing of construction drawings.

(sixteen) the reform of affordable housing sales. Real estate development enterprises shall, after obtaining the "Pre-sale Permit for Commercial Housing" for affordable housing, hand over the affordable housing to the municipal housing security and real estate management department for agency sales.

(seventeen) strictly supervise the sales price. The winning bid price of real estate development enterprises is the highest average selling price of affordable housing. The winning bid price, reserve price and directional price difference shall be announced to the public by the price management department of the municipal government.

The sale of affordable housing shall be clearly marked, and no unmarked fees shall be charged in addition to the marked price.

(eighteen) strictly implement the audit procedures of the supply object, and apply for the purchase of affordable housing, in accordance with the following procedures:

1, application

Families applying for the purchase of affordable housing shall submit a written application to the subdistrict office and township (town) people's government where the household registration is located, fill in the application form for the purchase of affordable housing, and provide the following materials:

(1) proof of family income;

(2) proof of family housing status;

(3) family members' ID cards and household registration books;

(4) Other supporting materials.

Step 2 review

Step 3 publicize

After examination, if the family income and family housing conditions meet the prescribed conditions, the district (county) housing security management department shall summarize the relevant information of the applicant and report it to the municipal housing security and real estate management department. Do not meet the conditions, notify the applicant in writing and explain the reasons. If the applicant disagrees with the audit results, he may appeal to the municipal housing security and real estate management department. The municipal housing security and real estate management department shall publicize the eligible applicants in relevant media for 15 days.

Step 4 agree

After publicity, if there is no objection or the objection is not established, the municipal housing security and real estate management department will issue the "Affordable Housing Purchase Permit" within 15 working days.

After examination or review, if the objection is established, the "prospective purchase certificate of affordable housing" shall not be issued, and the reasons shall be explained to the applicant.

Step 5 buy a house

Applicants who have obtained the quasi-purchase certificate of affordable housing can wait to buy a set of affordable housing with the quasi-purchase certificate of affordable housing to the city low-rent housing and affordable housing management center.

To provide affordable housing to low-income families, when the number of applicants exceeds the number of affordable housing units available, arrangements shall be made according to the family income level from low to high. Under the same conditions, the purchaser is determined by drawing lots.

(nineteen) the reform of affordable housing transfer measures. Affordable housing belongs to policy housing, and buyers have limited property rights.

3, did not obtain the qualification to buy affordable housing families to buy affordable housing, the purchase of affordable housing by the affordable housing management department within a time limit according to the original price and consider factors such as depreciation pricing acquisition; Can't buy, by the affordable housing management department instructed it to pay the difference between affordable housing and similar ordinary commodity housing in the same lot, and the relevant responsible units and responsible persons shall be dealt with according to law.

4, to resort to deceit, conceal family income and housing conditions, defrauding individuals to buy affordable housing, by the municipal administrative department of affordable housing within a time limit according to the original price and considering depreciation and other factors pricing to recover the purchased housing, and in accordance with the laws and relevant provisions of accountability. If a false certificate is issued, the relevant responsible person shall be investigated for responsibility according to law.

Fourth, gradually improve the living conditions of other groups with housing difficulties.

Renovation of shanty towns (dilapidated housing areas) that are not worthy of improvement, protection and utilization. The renovation project of shanty towns (dilapidated houses) in the main urban area is included in the scope of renovation of old urban areas and urban villages, and the renovation plan and annual demolition plan are formulated by the headquarters office of the renovation project of old urban areas and urban villages, enjoying relevant preferential policies of the government. Adhere to the leadership of government departments, policy support and market operation. Cities, counties (cities) and Fengfeng mining areas should integrate the existing institutional resources of real estate management departments, and set up low-rent housing and affordable housing management centers before the end of 2007 as non-profit organizations, which are specifically responsible for the purchase and construction of low-rent housing, maintenance and management, rental housing subsidies, preliminary work of affordable housing projects and sales agents. The municipal editorial office should supervise the implementation of the preparation.

The financial department shall provide the necessary working funds for the housing security management department and its working institutions. Municipal construction, planning, finance, civil affairs, prices, taxation, development and reform, land resources and housing provident fund management departments should carry out their duties, cooperate with each other, strengthen services, and do a good job in housing security.

(twenty-nine) the preparation and serious implementation of affordable housing and low-cost housing planning. Urban housing construction and housing security planning should reasonably determine the construction scale and proportion structure of affordable housing and low-rent housing, coordinate with urban housing development planning, and implement specific projects in each plot, and implement construction indicators every year.

(thirty) to ensure the quality and function of the house. The construction of low-rent housing and affordable housing, the renovation of old residential quarters and the renovation of shanty towns (dilapidated residential quarters) should adhere to the principle of economic application, improve the level of planning and design, and realize basic use functions in smaller units. In accordance with the requirements of developing energy-saving, land-saving and environment-friendly housing, we will promote new materials, new technologies and new processes. Construction management must be strengthened to ensure construction quality.

(thirty-one) all relevant departments should put solving the housing difficulties of low-income families on an important agenda, strengthen leadership, and earnestly implement various policies and measures. The municipal government will incorporate the housing security work into the target responsibility system management of relevant departments and conduct assessment at the end of each year. If the work is not implemented, the measures are not in place, and the objectives and tasks cannot be completed, informed criticism will be awarded.

(thirty-two) this opinion is applicable to the main city of Handan, and other counties, cities and Fengfeng mining areas can refer to this opinion and formulate specific implementation plans in combination with local conditions.

(thirty-three) this opinion shall be implemented as of the date of issuance. In the past, if the relevant provisions of this Municipality are inconsistent with this opinion, this opinion shall prevail.
