Patent application documents have specific writing requirements, and the applicant can fill them out by himself or by an agency.
2. Acceptance of patent applications
After receiving the patent application, the Patent Office or the agency of each patent office shall determine the application date, give the application number, and issue a notice of acceptance to the application that meets the acceptance conditions.
Step 3 pay the handling fee
The application fee and other handling fees can be paid in person at the toll office of the Patent Office or the agency of the Patent Office, or remitted by bank or post office.
4. Patent approval
According to the Patent Law, the examination and approval procedure of an application for a patent for invention includes five stages: acceptance, preliminary examination, publication, actual examination and authorization. When examining and approving an application for a patent for utility model or design, there are only three stages: acceptance, preliminary examination and authorization.
In the process of patent examination and approval, the Patent Office will issue notice documents such as rectification notice and examination opinion notice for the problems in the application documents. The applicant needs to reply to the notice within the time limit specified in the notice. If the applicant fails to reply within the time limit, the patent application will be deemed to be withdrawn and terminated.
5. Rejection of patent application
Patent applications that fail to meet the requirements for granting patent rights after examination will be rejected.
6. Patent reexamination
The rejected patent application can be re-authorized through the review procedure. If the reexamination procedure is not selected, the patent application procedure shall be terminated.
7. Patent registration procedures.
If the application for a patent for utility model has been examined in advance and the application for a patent invention has been examined in substance, and there is no reason for rejection, the Patent Office must issue a notice of approval and a notice of registration procedures.
After receiving the notice of approval and registration, the applicant must go through the registration formalities and pay the prescribed handling fee within two months through the notice. Since then, the Patent Office has granted patents and issued patent certificates. Failure to pass the registration method within the prescribed time limit shall be regarded as giving up the right to obtain the patent right.
