"Measures for the Administration of the Release of Government Procurement Information"
Article 1: In order to regulate the release of government procurement information and improve the transparency of government procurement, in accordance with the "Government Procurement Law of the People's Republic of China" 》"Regulations on the Implementation of the Government Procurement Law of the People's Republic of China" and other relevant laws and administrative regulations, these measures are formulated.
Article 2: These Measures shall apply to the release of government procurement information.
Article 21 These Measures will come into effect on March 1, 2020. The "Measures for the Administration of Government Procurement Information Announcements" (Ministry of Finance Order No. 19) promulgated and implemented by the Ministry of Finance on September 11, 2004 shall be abolished at the same time.
Five major methods of government procurement
1. Public bidding
Public bidding is the main procurement method of government procurement. Public bidding is not in parallel with other procurement methods.
The specific amount standard for public bidding shall be stipulated by the State Council for government procurement items belonging to the central budget; for government procurement items belonging to local budgets, shall be stipulated by the people's governments of provinces, autonomous regions, and municipalities directly under the Central Government; open bidding shall be adopted due to special circumstances. Procurement methods other than bidding must obtain approval from the procurement supervision and management department of the people's government at or above the districted city or autonomous prefecture level before the procurement activities begin.
Purchasers shall not break goods or services that should be procured through public bidding into parts or avoid public bidding in any other way.
2. Invitation bidding
Invitation bidding is also called selective bidding. The purchaser selects a certain number of legal persons or other organizations based on the credit and performance of suppliers or contractors (cannot less than three), issue a bidding invitation to them, invite them to participate in the bidding competition, and select the winning supplier.
Conditions:
(1) It is special and can only be purchased from a limited range of suppliers;
(2) It adopts public bidding method The cost accounts for an excessively large proportion of the total value of the government procurement project.
3. Competitive negotiation
Competitive negotiation means that the purchaser or agency negotiates with multiple suppliers (not less than three) and finally determines the winning supplier.
Conditions:
(1) After the bidding, no supplier bids or there is no qualified bid or the re-bidding fails to be established;
(2) The technology is complex or Special nature, detailed specifications or specific requirements cannot be determined;
(3) The time required for bidding cannot meet the urgent needs of users;
(4) The total price cannot be calculated in advance of.
According to the provisions of Article 43 of Order No. 18 of the Ministry of Finance, if there are less than three suppliers participating in the bidding after the bidding deadline, or during the bid evaluation period, there will be suppliers that meet professional conditions, or if there are any changes to the bidding documents, If there are less than three suppliers that actually respond, competitive negotiation procurement may be adopted upon approval by the government procurement supervision and management department.
4. Single source
Single source procurement is also called direct procurement, which means that the quota standards and public bidding amount standards are met, but the source of the purchased goods is single or patented , initial manufacturing, contract additions, subsequent expansion of original procurement projects, and unforeseen emergencies that prevent procurement from other suppliers. The main feature of this procurement method is that it is non-competitive.
Conditions:
(1) Can only be purchased from the only supplier;
(2) Unable to purchase from other suppliers due to unforeseen emergencies. Procured from suppliers;
(3) The consistency of the original procurement items or the requirements for supporting services must be ensured, and additional purchases need to be continued from the original suppliers, and the total additional purchase funds shall not exceed the original contract purchase amount. Ten percent.
5. Inquiry
Inquiry means that the purchaser sends an inquiry to the relevant suppliers to ask them to quote, and then compares and determines the best supplier based on the quotations. Procurement method. Conditions: When the specifications and standards of the purchased goods are unified, the spot supply is sufficient, and the price changes are small for government procurement projects, the inquiry method can be used for procurement.
