Article 4 The State Forestry Administration is responsible for the protection and management of forest germplasm resources throughout the country, and its subordinate forest seedling management institutions are responsible for the specific work.
The competent forestry authorities of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall be responsible for the protection and management of forest germplasm resources within their respective administrative areas, and the specific work shall be undertaken by the forest seedling management institutions to which they belong. Article 5 The State supports the protection of forest tree germplasm resources. The competent forestry authorities of the people's governments at or above the county level shall take effective measures to strengthen the protection and management of forest germplasm resources. Article 6 The competent forestry authorities of the people's governments at or above the county level shall actively organize scientific research on forest germplasm resources, train professional and technical personnel of forest germplasm resources, and improve the protection and management level of forest germplasm resources. Article 7 The State Forestry Administration and the competent forestry authorities of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall organize the general survey of forest germplasm resources and establish and improve the archives of forest germplasm resources.
Data such as the results of the general survey of forest germplasm resources should be used as the basis for formulating the protection and development plan of forest germplasm resources and formulating and adjusting the catalogue of available forest germplasm resources. The eighth national forest germplasm resources survey plan was formulated by the State Forestry Administration; The general survey plan of local forest germplasm resources shall be formulated by the competent forestry authorities of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government. Article 9 The competent forestry authorities of the people's governments at or above the county level shall organize the collection of forest germplasm resources in a planned way according to the needs of protecting forest germplasm resources. Tenth units and individuals that collect forest germplasm resources shall establish original files and keep them intact. The content and format of the original records shall be uniformly stipulated by the State Forestry Administration. Article 12 The State Forestry Administration and the competent forestry authorities of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall organize relevant experts to identify the collected forest germplasm resources. The identification of forest germplasm resources should strictly implement national standards and industry standards. Article 13 The State Forestry Administration and the competent forestry authorities of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall register the recognized forest germplasm resources or the forest germplasm resources imported from abroad with approval. The registration of forest germplasm resources shall be numbered uniformly throughout the country, and the numbering method shall be stipulated by the State Forestry Administration. No unit or individual may change or number it separately. Article 14 The State Forestry Administration shall establish a national forest germplasm resource bank according to needs to preserve forest germplasm resources with important value or preciousness. The competent forestry authorities of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government may, according to needs, establish forest germplasm resource banks, forest germplasm preservation areas or forest germplasm resources protection areas to preserve forest germplasm resources such as native trees and local main afforestation trees. Article 15 The people's governments at or above the county level shall, according to the situation, preserve the forest germplasm resources by means of local preservation or establishment of remote storage and facility storage, so as to ensure the normal operation of national and local forest germplasm resources banks, protected areas and protected areas and the safety of germplasm resources. The forest germplasm resources in remote repositories and facility repositories shall be regularly inspected and tested in accordance with relevant regulations, and updated and supplemented in a timely manner. Article 16 The State Forestry Administration and the competent forestry authorities of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government shall, according to the results of general survey, appraisal and preservation, publish the catalogue of available forest germplasm resources. Article 17 Whoever applies for the right to new plant varieties or other patent rights by using the forest germplasm resources obtained from the forest germplasm resource bank shall sign an agreement with the forest germplasm resource management unit in advance and report it to the competent forestry department of the people's government of the province, autonomous region or municipality directly under the Central Government or the State Forestry Administration for the record. Eighteenth units and individuals that use the forest germplasm resources of the forest germplasm resources bank shall sign an agreement with the management unit of the forest germplasm resources bank, and undertake the obligation of information feedback and utilization in accordance with the requirements of the agreement. Article 19 It is forbidden to collect or cut natural forest germplasm resources under special state protection. If it is necessary to collect or cut due to special circumstances such as scientific research, improved seed selection, cultural exchange and renewal of germplasm resources, in addition to submitting the approval documents for collection or cutting in accordance with the provisions of relevant laws and regulations, it shall also go through the examination and approval procedures in accordance with the provisions of paragraphs 2 and 3 of this article.
In the case of collecting or cutting in the national database of forest germplasm resources, the applicant shall submit an application form and an application description for collecting or cutting forest germplasm resources to the State Forestry Administration, which shall include the reasons, uses and schemes of collecting or cutting; The State Forestry Administration shall make a decision on examination and approval within 20 working days from the date of acceptance, and issue a license for the collection or cutting of forest germplasm resources; If it is not approved, it shall inform the applicant in writing and explain the reasons.
Collection or logging outside the national forest germplasm resource bank shall be approved by the competent forestry authorities of the people's governments of provinces, autonomous regions and municipalities directly under the Central Government, and the approval results shall be reported to the State Forestry Administration for future reference.
