Measures of Shaanxi Province for the Administration of Engineering Construction Standards

Chapter I General Provisions

Article 1 In order to strengthen the standardized management of engineering construction, promote scientific and technological progress, promote the high-quality development of construction projects, and safeguard public interests, these Measures are formulated in accordance with the People's Republic of China (PRC) Standardization Law, the Measures for the Administration of National Standards for Engineering Construction and other laws, regulations and rules.

Article 2 These Measures shall apply to the compilation, implementation, supervision and management of standards for housing construction and municipal infrastructure projects within the administrative area of this province.

Article 3 The task of engineering construction standardization is to formulate and revise local standards for engineering construction, organize the implementation of national standards, industrial standards and local standards, supervise the implementation of engineering construction standards, and standardize, guide and supervise the formulation of engineering construction group standards.

Fourth provincial standardization administrative departments unified management of the province's standardization work, the provincial administrative department of housing and urban construction division of labor management of the province's engineering construction standardization work.

Provincial housing and urban and rural construction administrative departments shall be responsible for the establishment and implementation of the project construction standards in the province according to law; Organize the implementation of national standards, industry standards and local standards for engineering construction, and supervise the implementation of national standards, industry standards, local standards and group standards.

Under the organization of the provincial housing and urban and rural construction administrative departments, the provincial construction standard design station (hereinafter referred to as the "provincial standard station") specifically undertakes the demonstration, compilation, review, revision, consultation, publicity and training of the province's engineering construction standards.

City, county (city, district) housing and urban and rural construction administrative departments are responsible for the implementation and supervision of national standards, industry standards and local standards for engineering construction within their respective administrative areas.

Article 5 Engineering construction standards with high technical level and remarkable economic, social or ecological benefits shall be included in the scope of awards for scientific and technological achievements in construction projects and excellent survey and design awards.

The achievements of local standards and group standards for engineering construction are included in the main achievements of unit credit system construction and personal title evaluation.

The main technicians who participated in the compilation of standards can be regarded as having completed 50% of the elective courses of continuing education within the corresponding registration period.

Article 6 Societies, associations, chambers of commerce, federations, industrial technology alliances and other social organizations with corresponding professional skills and standardization capabilities are encouraged to cooperate with social market players to formulate standards for engineering construction groups that meet the needs of the market and innovation, and the members of this group will agree or voluntarily adopt them according to the provisions of this group. Group standards implement the system of self-declaration, publicity and supervision, and actively accept the guidance of relevant departments.

The technical requirements of engineering construction group standards shall not be lower than the mandatory national standards, and the technical requirements of engineering construction group standards shall be encouraged to be higher than the national standards, industry standards and local standards.

Seventh engineering construction standardization work funds should be included in the financial budget of the people's government at the same level.

Chapter II Formulation of Engineering Construction Standards

Eighth in the following engineering construction activities, there is no national standard or industry standard, or although there are provisions, but the provisions are not specific, or in order to refine and improve the national standards and industry standards, it is necessary to unify the technical requirements and management requirements of the province's engineering construction, and the province's engineering construction standards can be formulated:

(a) the quality and safety requirements of engineering construction survey, design, construction (including installation) and completion acceptance;

(two) the technical requirements of safety, environmental protection, earthquake (epidemic) emergency and energy resources conservation and utilization of engineering construction;

(3) Requirements for applying new technologies, new processes and new equipment in engineering construction;

(four) the requirements of engineering construction for testing, inspection, testing and evaluation methods;

(five) the requirements of the project construction for special information technology;

(six) the relevant technical requirements of urban construction and management, including municipal infrastructure and public facilities allocation standards, urban renewal, urban design, urban history, culture and style standards;

(seven) other engineering construction technology and management requirements.

Article 9 The formulation of local standards shall meet the following conditions:

(a) strictly abide by (comply with) the relevant laws, regulations, rules and technical and economic policies of the state and our province, reflecting the local geographical environment and technical characteristics;

(2) Based on scientific and technological research achievements and practical experience, the corresponding scientific research achievements have been identified or technically mature and applied in engineering construction, which meets the requirements of advanced technology, economic rationality, safety and application, and has the conditions for popularization and application;

(three) the technical requirements in the standard are not lower than the national standards and industry standards for engineering construction, and shall not conflict with the national standards and industry standards, and shall be coordinated with the relevant local standards, and shall not be repeated or contradictory;

(4) Where patented technology is adopted, the permission of the patentee shall be obtained;

(five) the formulation and implementation of standards shall not hinder the free circulation of goods and services and other acts of excluding or restricting market competition; Do not specify the use of building materials, building components and facilities prohibited by the state and the whole province.

Tenth local standards for engineering construction shall be managed by plan, and the provincial administrative department of housing and urban and rural construction shall solicit opinions from the public every year, formulate local standards, prepare annual plans and announce them to the public.

Eleventh local standards for engineering construction editor units in principle not more than 2; There are 2 editor-in-chief units, and the standard preparation work is led and completed by the first editor-in-chief unit.

The editor-in-chief units and editors who undertake the compilation of local standards shall meet the following conditions:

(1) Having the qualification of a legal person, having undertaken scientific research, survey, design, construction, testing and other work related to the compiled standards, having a high level in relevant fields, and being able to solve major technical problems in the compilation of standards.

(two) to undertake the preparation of engineering construction management standards, it should have corresponding management experience, and the corresponding level is in the leading position in the industry.

(three) the work of the editor-in-chief should conform to the standards and standard design, and has rich work experience and engineering practice.

Twelfth declaration shall be made in written form, including the formulation of project application form and project application report.

If the standard content involves patents, the relevant certificates of patents, the authorization documents of the patentee, the patent license statement and other materials shall be provided in the project application report.

Thirteenth provincial housing and urban construction administrative departments in conjunction with the provincial standardization administrative departments organized an expert demonstration meeting to demonstrate the necessity and feasibility of applying for the project, and put forward written argumentation opinions.

Through the project demonstration, the provincial administrative department of housing and urban and rural construction and the provincial administrative department of standardization shall issue the annual project plan to the preparation unit.

New technologies, new processes and new equipment to be adopted in local standards for engineering construction shall be demonstrated by experts organized by provincial standard stations.

Fourteenth projects that have been included in the annual revision plan of local standards should be completed within 2 years. In case of special circumstances in the implementation of the plan, which cannot be implemented according to the original plan, the editor-in-chief unit shall apply to the provincial administrative department of housing and urban-rural construction for planning change, and organize the implementation according to the adjusted time node after approval, and the change result shall be notified to the provincial administrative department of standardization in a timely manner.

Fifteenth after the approval of the project, the editor-in-chief unit shall formulate a standard preparation plan according to the approval of the project. The preparation plan includes the composition of the preparation unit and personnel, the division of tasks, the preparation progress and other related contents; The plan should be submitted to the provincial housing and urban construction administrative department for the record within 60 days.

Article 16 The formulation and revision of the compilation format and rules of engineering construction standards shall conform to the standards GB/T 1. 1, standardization work guide GB/T20000, standard compilation rules GB/T2000 1, and engineering construction standards compilation regulations (standard [

Article 17 The compilation team shall fully carry out investigation and study according to the standard compilation plan, and compile the draft standard and its provisions on the basis of comprehensive analysis and necessary experimental demonstration.

The draft for comments should be approved by the editor-in-chief unit and the editor-in-chief department, and then seek the opinions of relevant units and experts.

Eighteenth provincial housing and urban construction administrative departments to solicit opinions on the draft standard online, the time is not less than 30 days.

The scope and object of soliciting opinions should be extensive and representative, and the editor-in-chief unit should seek the opinions and suggestions of relevant units and experts simultaneously according to the survey, design, construction, supervision and testing involved in the standard. The number of experts seeking opinions shall not be less than 5.

Article 19 the standard editor-in-chief unit shall sort out, analyze, study and process the collected opinions, complete the draft standard and solicit opinions, summarize the processing results table, and submit the written application materials to the provincial administrative department of housing and urban construction, which will organize experts to hold a review meeting jointly with the provincial administrative department of standardization. Review experts shall be drawn from the local standard expert database of engineering construction, and the number of experts shall be no less than 7.

Twentieth manuscript materials should be complete (paper version and electronic version), the standard editor should carefully prepare the review report materials. The contents of the report should include: the source of the task, the main work done in the preparation of the standard, the key technologies and innovations of the standard, and the handling of soliciting opinions and suggestions.

Article 21 The expert group shall review the following main contents.

The content of the standard conforms to the relevant national laws, regulations and mandatory standards, and is coordinated with relevant national standards, industry standards and local standards;

Handling of major differences in standards, and whether the opinions of all parties concerned have been coordinated;

The scientificity, completeness and operability of the main technical contents of the standard; Whether the structure, elements and contents of the standard are complete, whether the provisions are correct, whether the technical indicators are appropriate and whether the methods are verified.

Twenty-second review meeting should listen to the compilation team to introduce the standard compilation process and main contents, and solicit opinions on handling; The technical review is presided over by the leader of the expert group, which reviews the standard texts one by one, organizes and coordinates the major issues encountered in the review, and fully discusses and negotiates the controversial issues.

Meeting review shall form meeting minutes. The minutes of the meeting mainly include the general situation of the meeting and the main evaluation opinions, and shall be signed by all the experts of the evaluation team.

Twenty-third the preparation team shall, according to the expert review opinions, modify the draft standard and form the draft standard for approval. If the expert review opinions pass or fail in principle, the compilation team shall revise the standards according to the expert review opinions and re-submit them for approval.

Chapter III Approval and Filing of Standards

Twenty-fourth standard editor units should submit materials for approval to the provincial administrative department of housing and urban and rural construction within 30 working days after the expert review meeting.

The materials submitted for review include: the signing form of Shaanxi engineering construction standards submitted for review, the standard submission request document, the draft of standards submitted for review, the expert opinions and opinions signing form of the review meeting, and the results of expert opinions.

Twenty-sixth local standards for engineering construction shall be uniformly numbered by the provincial administrative department of housing and urban-rural construction in accordance with the provincial administrative department of standardization, and jointly issued by the provincial administrative department of housing and urban-rural construction and the provincial administrative department of standardization.

Local standards for engineering construction without approval and filing shall not be published in any form and shall not be used in construction activities.

Twenty-seventh local standards for engineering construction issued by the provincial administrative department of housing and urban construction, the provincial standard station implementation. Without permission, no unit or individual may reprint or copy the local standards of engineering construction in this province for sale.

Chapter IV Examination, Evaluation and Revision of Standards

Twenty-eighth after the promulgation and implementation of local standards for engineering construction, it should be timely reviewed and evaluated according to the development of science and technology, the needs of engineering construction and the formulation and revision of national standards and industry standards. The review and evaluation period is generally not more than 5 years.

The review and evaluation of standards shall be carried out under the unified organization of the provincial administrative department of housing and urban and rural construction.

Twenty-ninth local standards review and evaluation shall be handled in the following ways:

(1) Local standards shall be abolished under any of the following circumstances:

1, which does not conform to the current relevant laws, regulations and policies;

2, with the current national standards, industry standards content contradiction or a lot of repetition;

3. The main technical content is no longer applicable.

(two) local standards in any of the following circumstances, should be revised:

1, involving major changes in laws, regulations, rules or relevant state regulations;

2. The existing national standards and industry standards involved have been revised;

3. The key technologies and applicable conditions of the standard have changed;

4. Other circumstances that need to be revised.

The provincial administrative department of housing and urban and rural construction shall, jointly with the provincial administrative department of standardization, announce the abolition, revision or continued validity of local standards according to the review and evaluation conclusions, and announce them to the public in a timely manner.

Thirtieth local standards need to be revised, by the editor-in-chief unit to apply for revision, in accordance with the procedures submitted to the provincial housing and urban and rural construction administrative departments for revision, release and filing. For the revised standard, the serial number of standard publication remains unchanged, only the year of approval for publication has been changed.

When the revised local standards are re-issued, the original local standards shall be abolished. If the original standard has not been explicitly abolished, the original standard will no longer be applicable from the date of implementation of the new standard.

Article 31 For local standards that continue to be effective, the words "confirmed to be effective on * * * * year * * month" shall be added below the implementation date of the standard title page when they are reprinted or compiled after being confirmed by the provincial administrative department of housing and urban-rural construction.

Chapter V Implementation of Engineering Construction Standards

Thirty-second local standards for engineering construction are the technical basis and criteria for engineering construction activities. Encourage construction, planning, survey, design, construction, supervision, construction drawing review, engineering quality inspection institutions and other units and employees to adopt local standards for engineering construction when engaging in related engineering construction activities.

Article 33 The design of engineering construction standards is a technical supplement and extension of engineering construction standards.

The provincial administrative department of housing and urban and rural construction shall organize the relevant units to prepare the general standard design of construction projects and the standard design for the popularization and application of related products, and provide technical support for the implementation of construction standards.

Encourage architectural engineering design enterprises to give priority to standard design in design.

These Measures shall apply to the compilation, compilation, implementation, supervision and management of engineering construction standard design projects.

Thirty-fourth people's governments at or above the county level shall, according to the actual needs, actively organize the publicity and implementation of national standards, industry standards and local standards for engineering construction, and meet the following requirements:

(a) the standard publicity activities should be carried out under the unified organization;

(two) communication standards should be included in the continuing education plan for professional and technical personnel;

(three) the standard should ensure the quality and level, and the commentator engaged in the publicity of the standard should give priority to those who participate in the preparation of the standard;

(four) the standard publicity activities should strictly implement the relevant provisions of the state.

Thirty-fifth local standards shall be interpreted by the provincial administrative department of housing and urban construction. Involving the specific technical content of the standard, it may entrust the standard editor-in-chief unit to issue relevant technical instructions. Interpretation of standards shall conform to the relevant provisions of the Administrative Measures for Interpretation of Engineering Construction Standards issued by the Ministry of Housing and Urban-Rural Development.

Chapter VI Supervision over the Implementation of Engineering Construction Standards

Thirty-sixth administrative departments of housing and urban and rural construction at all levels shall uniformly organize the supervision and inspection of the implementation of engineering construction standards within their respective administrative areas, and promptly investigate and deal with illegal acts found. The results of supervision, inspection and handling shall be made public according to law and incorporated into the management of the credit system.

Article 37 The supervision and inspection of engineering construction standards shall be carried out in a "double random and one open" way, and shall conform to the relevant requirements of the Supervision Regulations on the Implementation of Compulsory Standards for Engineering Construction (OrderNo. 12 of 2004). Thirty-ninth in violation of the provisions of these measures, the administrative department of housing and urban construction of the people's government at or above the county level and other relevant departments have one of the following acts, and the directly responsible person in charge and other directly responsible personnel shall be investigated and punished according to law.

(a) failing to organize the preparation of local standards in accordance with the prescribed procedures and standards;

(two) failing to perform the duties of supervision and inspection of engineering construction standards according to law;

(four) other acts of abuse of power, dereliction of duty, favoritism.

Chapter VII Supplementary Provisions

Article 40 These Measures shall come into force on August 8, 20021year and be abolished on August 7, 2026, with a validity period of 5 years.
