What does service invention mean?

Service invention refers to the invention made by performing the tasks of the unit or mainly using the material and technical conditions of the unit, including four situations:

1. Inventions made in his own job For example, the inventor's own job is the design of food machinery, and he has completed an invention of equipment for making steamed bread. This invention is a job invention.

2. Inventions and creations made by performing tasks other than those assigned by the unit. For example, the inventor was originally engaged in radio communication research and was temporarily appointed by the unit to design new furniture. His invention is also a job invention.

3. According to the Patent Law of inventions made mainly by relying on the material and technical conditions of the company (1993), only by "using the material conditions of the company", including funds, equipment, spare parts and raw materials, can they be recognized as service inventions. However, with the development of economy and the enrichment of market, many material conditions can be easily obtained by inventors or designers from ways other than "their own company", so they are no longer suitable as the main criteria for judging whether they belong to service inventions. Therefore, in the new patent law implemented in 200 1, in addition to material conditions, technical conditions are also added as standards. The technical conditions here include technical materials that have not been disclosed to the public and are related to the originality of our company.

4. Inventions and creations related to one's own work or tasks assigned by the original unit made within one year after resignation, retirement or transfer of work were completed during working hours or spare time. As long as it belongs to one of the above four situations, even if the inventor or designer uses his spare time to make an invention, it is also a service invention.
