How to modify a submitted patent application

(1) Submit a replacement page

According to the provisions of Article 52 of the Implementing Rules of the Patent Law, the revised part of the description or claims, except for the modification or addition or deletion of individual words, , the replacement page should be submitted in the prescribed format. There are two ways to submit a replacement page.

1. Submit reprinted replacement pages and revised comparison tables - this method is suitable for descriptions, claims and all revised drawings that have a lot of revised content. When submitting the replacement page, the applicant must submit a detailed list of contrast lighting before and after the modification.

2. Submit a reprinted replacement page and a comparison page with modifications made in the copy of the original document - this method is suitable for descriptions and claims with less modification content. The applicant submits a control page modified directly on the copy of the original document at the same time as the reprinted replacement page, making it easier for the examiner to detect the modified content. Applicants must submit replacement pages in duplicate.

(2) The examiner makes modifications on your behalf

Usually, modifications to the application must be submitted by the applicant in the form of a formal document. For modifications, additions or deletions of individual words and marks in the application documents, as well as obvious errors in the title or abstract of the invention, the examiner may make modifications ex officio and notify the applicant. At this time, clear and obvious modifications should be made with a pen, rollerball pen or ballpoint pen, and not with a pencil.
