Type determination:

In China, there are three types of patents: design patents, utility model patents (called new models in Hongkong, but there is no utility model patent in some developed countries) and invention patents. Choose the protection method according to your own protection point for the product.

If you need to protect the shape, pattern, color and the combination of the three, you need to apply for a patent for appearance. The product applying for appearance must be a three-dimensional product.

If it is necessary to protect the shape and structure of products or put forward applicable new technical solutions in combination with them, it is generally necessary to apply for a patent for utility model.

If the creativity and novelty of the product are unprecedented, then apply for an invention patent. At the same time, only one invention patent can be applied for the method or formula of producing, processing and manufacturing a certain product.

To judge the types of patents, it is best to entrust an agency with professional classification by its patent agents.
