Collection of filing fees for customs protection of intellectual property rights (AnnouncementNo. 15, General Administration of Customs, 2004)

According to Article 32 of the Regulations on Customs Protection of Intellectual Property Rights in People's Republic of China (PRC), if an intellectual property right holder files his intellectual property rights with the General Administration of Customs, he shall pay the filing fee in accordance with the relevant provisions of the state. The collection of filing fees is hereby announced as follows:

1. Where an intellectual property right holder applies to the General Administration of Customs for customs protection of intellectual property rights, the applicant shall pay an application fee of 800 yuan for each application.

2. The applicant shall remit the filing fee to the special account of the General Administration of Customs through the bank. The General Administration of Customs does not accept remittance by post office or payment of filing fees by cash, cheque or other forms.

3. The applicant shall pay the filing fee in advance before submitting the filing application to the General Administration of Customs, and attach a copy of the bank transfer form of the filing fee to the filing application. Without a copy of the bank transfer bill, the General Administration of Customs will not accept the filing application.

Four, the General Administration of Customs granted the customs protection of intellectual property rights for the record, it shall issue a receipt to the applicant for the record fee; If the General Administration of Customs refuses to put on record, it shall refund the filing fee to the applicant.

Five, the applicant applies for renewal or change of filing within the validity period of filing, no longer pay the filing fee. If the applicant applies for filing again after the failure of filing, it shall pay the filing fee again.

The filing fee paid by the applicant will not be refunded if the filing of the customs protection of intellectual property rights is cancelled or revoked by the General Administration of Customs according to law or is invalid for other reasons.

Six, this announcement shall come into force as of July 1 2004. 1 July 19971July 1997, the provisions of the general administration of customs on customs protection fees for intellectual property rights shall be abolished at the same time.
