(a) what the predecessors did not have means that the creative technical content of the project is not available at home and abroad, or although it is available at home and abroad, the technical confidentiality has not been made public;
(2) The advanced nature means that the comprehensive level of the project in terms of creativity, scientific and technological level, performance indicators and its role in promoting scientific and technological progress is superior to the existing similar technologies at home and abroad at the application date;
(3) It is proved to be applicable by practice, which means that the project has passed the appraisal or acceptance, adopted in the national defense field, and achieved benefits; Or it can be applied experimentally, which is of great significance to national defense construction and has potential benefits. Article 4 Confirmation of inventors and invention units:
An inventor refers to a person who mainly completes part or all of the creative technical content of an award-winning project by himself. In general, the total number of inventors of each project shall not exceed 6. If there are more than 6 people who have completed the creative technical content of the project, the inventor refers to the top 6 people who have made significant creative contributions. People who only engage in auxiliary work and organizational management should not be listed as inventors.
Invention unit refers to the unit where the project inventor completed the invention.
Inventors and invention units should be arranged in order of contribution. Article 5. Where the declaration of the national defense special invention award, should indicate the classification, and strictly abide by the relevant state secrecy provisions. Article 6 In accordance with the Regulations of People's Republic of China (PRC) on Invention Awards, the Commission of Science, Technology and Industry for National Defense (hereinafter referred to as the Commission of Science, Technology and Industry for National Defense) shall set up a national defense science and technology invention award evaluation committee (hereinafter referred to as the National Defense Science and Technology Evaluation Committee).
The Commission of Science, Technology and Industry for National Defense shall have 1 a number of directors and deputy directors, 1 a number of secretaries-general and members. The term of office is three years.
Its main responsibilities are:
(a) responsible for the evaluation of the national invention award for national defense projects;
(two) to examine and recommend the national invention award and the national defense special award;
(three) to make a ruling on the major objections of the national defense special award project;
(four) to formulate specific measures for the national invention award for national defense.
The daily office of the National Defense Science and Technology Review Committee is the Office of the National Defense Science and Technology Review Committee, which is located in the Office of National Defense Science and Technology Achievements of the National Defense Science, Technology and Industry Committee. Article 7 The National Defense Science and Technology Review Committee shall set up review groups for military nuclear technology, military aviation, military electronics, weapons, naval weapons and equipment, aerospace technology, military materials and other industries.
The industry appraisal team consists of 1 team leader, 2-3 deputy team leaders, several members and 1-2 permanent secretary. The term of office is three years.
Its main responsibilities are:
(a) responsible for the evaluation of the unemployment newspaper awards and the preliminary evaluation of the award level;
(two) to make a ruling on the major objections of the award-winning projects in this industry;
(three) to undertake other tasks entrusted by the national defense science and technology jury.
The daily work of the industry review team is the responsibility of the department where the team leader or permanent secretary works. Article 8 The application and approval procedures for the special national defense projects of the National Invention Award are as follows:
(a) the grass-roots units to the relevant departments in charge of the State Council (including headquarters), provinces, autonomous regions, municipalities directly under the central government, services, military regions, headquarters departments (hereinafter referred to as the reporting department) recommended.
(two) the reporting department is responsible for reviewing and reporting to the National Defense Science and Technology Jury.
(3) The Office of the National Defense Science and Technology Review Committee organizes review and pre-examination, and makes internal announcements on eligible projects and submits them to the industry review group;
(4) Two months from the date of publication is the objection period.
(5) The inventors shall prepare for the defense according to the requirements notified by the Commission of Science, Technology and Industry for National Defense, and each project shall be defended by 1 to 2 main inventors.
(six) the industry review group held a review meeting to conduct a preliminary review of the award level of the project and report the review results to the CSTIND.
(seven) the national defense science and technology jury held a review meeting to review the national invention award of national defense projects. Among them, the projects above the second prize will be evaluated item by item by the commission of science, technology and industry for national defense.
(eight) the evaluation results of the National Defense Science and Technology Jury shall be submitted to the State Science and Technology Commission for examination and approval and award after being approved by the National Science and Technology Commission. Grand prize project, approved by the State Science and Technology Commission reported to the State Council.
(9) If the project is evaluated as "delayed evaluation" by the Commission of Science, Technology and Industry for National Defense, the inventor shall submit a report requesting re-evaluation to the Office of the Commission of Science, Technology and Industry for National Defense through the original reporting department within 18 months from the date of publication of the evaluation results. If the request for re-evaluation is not made within the time limit, it shall be deemed to be revoked by itself. Article 9 To declare the special national invention award for national defense, it is necessary to fill in the unified declaration form of national invention award and prepare the necessary attachments. Among them, the novelty retrieval report of national defense special invention award shall be provided according to Document No.43 of the Commission of Science, Technology and Industry for National Defense (1988) "Provisions on Novelty Retrieval of National Defense Special Invention Award". For the project that has obtained the invention patent certificate, a copy of the invention patent certificate and the contents of the patent right shall be provided, and the novelty retrieval report may not be provided.
