How to pay the annual patent fee?
1. The patentee shall pay a certain fee every year from the year when the patent is granted to the end of the patent protection period. (1) The applicant shall pay the patent registration fee, announcement printing fee, stamp duty and the annual fee for the year when the patent right is granted. Where an application for a patent for invention needs to pay the application maintenance fee, the applicant shall pay the application maintenance fee for each year together. Failure to pay or pay the full fee at the expiration of the period shall be deemed as failure to go through the registration formalities. The annual fee for the year in which the patent right is granted shall be paid within the time limit specified in the notice of granting the patent right issued by the Patent Office, and the annual fee thereafter shall be paid in advance within one month before the expiration of the previous year. (2) The application maintenance fee needs to be paid. If the application for a patent for invention has not been granted a patent right for two years from the date of filing, the applicant shall pay the application maintenance fee from the third year. Anyone who becomes a patentee must pay an annual patent fee to protect his patent, which is an obligation of the patentee. The specific calculation method of paying the late payment fee is as follows: (1) If the time limit exceeds 1 day to 1 month (including 1 whole month), you only need to pay the annual fee instead of the late payment fee; (2) If the time limit exceeds 1 month to 2 months (including 2 whole months), the amount of overdue fine to be paid is 5% of the full annual fee; (3) If the time limit exceeds 2 months to 3 months (including 3 whole months), the amount of overdue fine to be paid is 1% of the full annual fee; (4) If the time limit exceeds 3 months to 4 months (including 4 whole months), the amount of overdue fine to be paid is 15% of the full annual fee; (5) If the time limit exceeds 4 months to 5 months (including 5 whole months), the amount of overdue fine to be paid is 2% of the full annual fee; (6) If the time limit exceeds 5 months to 6 months (including 6 whole months), the amount of overdue fine to be paid is 25% of the full annual fee. Third, when paying the annual patent fee, we should also pay attention to the following: (1) Pay the annual patent fee in person: When paying the annual patent fee, the payer should make clear the patent number and annual fee amount of the fee he should pay, fill in the payment list carefully, and verify the "Charge Receipt" in person after paying the fee. (2) Pay the annual patent fee by post: When paying the fee to the agency through post office remittance, you must fill in the necessary payment information in the message, and indicate the patent number at the end of the remittance slip. (3) Bank remittance: When paying fees to the agency through bank remittance, you should fax a copy of the bank remittance voucher, the patent number, fee type, contact person's name, telephone number, address and other relevant payment information to the patent agency after remittance.
