4.2 Correspondence between the applicant's statement of generic drugs and the drug patent claim

In accordance with the provisions of Article 6 of the Implementation Measures for the Early Resolution Mechanism of Drug Patent Disputes (Trial), the generic drug applicant declares that the technical scheme applied for is not within the scope of patent protection of the generic drug, and shall, in principle, declare the claim with the largest scope of protection corresponding to the generic drug to ensure the authenticity and accuracy of the statement. When two or more independent claims corresponding to generic drugs are made public on the drug patent information registration platform listed in China, the generic drug applicant shall state the two or more independent claims.
